Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be retained and carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following drawings – 24127-01H entitled 'Existing & Proposed Floor Plans & Elevations' Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 and the National Planning Policy Framework.
Within one month of this decision, the single-storey side extension shall be faced in materials to match the adjacent barn in accordance with details and specifications to be first submitted to and agreed in writing by the Local Planning Authority. The development shall be retained in accordance with the agreed facing materials. Reason: To ensure that the development is sympathetic to the character of the existing building and surrounding area together with ensuring that there is a limited impact on the setting of the heritage assets in accordance with Policies SWDP1, SWDP6, SWDP21, SWDP24, and SWDP25 of the South Worcestershire Development Plan, 2016.
Within one month of the date of this decision, the details of the boundary treatments to include details such as heights, materials and any treatment/ stain, shall be first submitted to and agreed in writing with the Local Planning Authority. The boundary treatments shall remain in accordance with those details agreed. Reason: To ensure that the development is sympathetic to the character of the existing building and surrounding area together with ensuring that there is a limited impact on the setting of the heritage assets in accordance with Policies SWDP1, SWDP6, SWDP21, SWDP24, and SWDP25 of the South Worcestershire Development Plan, 2016.
Within one month of the date of this decision, details and specifications including the siting of appropriate one bat and one bird box shall be submitted to and agreed in writing by the Local Planning Authority. The ecological features shall be incorporated into the development in accordance with the agreed details and be retained for the lifetime of the development. Reason: To ensure that adequate biodiversity enhancements are secured in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016.
The development hereby approved, shall ensure that the access, turning area and parking facilities shown on drawing reference '214127-01 Rev H have been provided. These areas shall thereafter be retained and kept available for their respective approved areas at all times. Reason: In the interests of highway safety and to ensure that there is adequate parking to serve the resultant dwelling in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 together with the parking standards set out within the Worcestershire County Council Streetscapes Design Guide, 2022.
The development hereby approved shall not have use of the vehicular access from the A4440 Swinesherd Way in accordance with the details provided in Drawing 214127-01 Rev H. Reason: In the interests of highway safety in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016.
No trees, shrubs or hedges within the site shall be felled, uprooted, wilfully damaged or destroyed, cut back in any way or removed without the prior written consent of the Local Planning Authority. Any trees, shrubs or hedges removed without such consent, or which die or become severely damaged or seriously diseased with five years from the completion of the development hereby permitted shall be replaced with trees, shrubs or hedge plants of similar size and species until the Local Planning Authority gives written consent to any variation. Reason: To ensure that the landscape characteristics are retained in the interests of the amenity and environmental quality of the locality in accordance with Policy SWDP25 of the South Worcestershire Development Plan, 2016.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking or re-enacting that order), no development (as defined by Section 55 of the Town and Country Planning Act 1990) as may otherwise be permitted by virtue of Class A,, Class AA, Class B, Class C, Class E, Class F of Part 1, Schedule 2 of the Order or Classes A or B of Part 2, Schedule 2 of the Order shall be carried out on the resultant dwellinghouse hereby permitted. Reason: To protect, conserve and enhance the character of the area together with preserving the character and setting of the heritage assets in accordance with Policies SWDP6, SWDP21, SWDP24 and SWDP25 of the South Worcestershire Development Plan, 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The applicant's attention is drawn to the existence of a unilateral undertaking made under Section 106 of the Town and Country Planning Act 1990 (as amended) and the restrictions imposed therein.
You are advised that this planning permission does not override any interests that third parties may have regarding civil matters such as ownership, covenants or private rights of way. Before any works are carried out which affect land outside your ownership you should ensure the necessary consents have been obtained from all persons having an interest in the land.
Within one month of the date of this decision, a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details within 12 months of the date of this permission. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
