Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents: • Location Plan 10518-100 C dated November 2024; • Proposed Site Plan 10518-201 E dated September 2025; • Proposed Plan & Elevations- Building-1 10518-311 dated July 2024; • Proposed Plan & Elevations- Building-11 10518-308 A dated July 2024; • Proposed Plan & Elevations- Buildings-2, 3, 4, 5, 6 & 7 10518-307 A dated June 2024; • Transport Statement ST/SC/25041-02 Transport Statement_FINAL dated 2nd August 2024; • Foul and Surface Water Drainage Strategy 24-163 A dated 1st August 2024; • Flood Risk Assessment 24-163-A dated 31 July 2024; • Planning Statement Heritage Impact Assessment Water Management Statement Energy Statement ADM/10518 dated August 2024. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No building operations hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include the type, colour, texture, size and design of roofing and walling materials. The development shall be carried out using the materials as approved. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No development shall take place until an Ecological Mitigation, Compensation and Enhancement Scheme (EMCES) has been drawn up by a suitably qualified ecologist and submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations made in the Preliminary Ecological Appraisal report, dated March 2024, and the Bat Activity Survey report, dated July 2024 both from Worcestershire Wildlife Consultancy and shall include: • Appointment of an Ecological Clerk of Works (ECoW); • Details on the times when the ECoW must be present to oversee the development; • Adoption of a Sensitive Lighting Scheme during construction works; • Reasonable Avoidance of the breeding season for birds (late February to late August, inclusive); • Details (including specifications and locations) of various artificial roosting features for bats to be installed around the site; • Details (including target species, specifications and locations) of the various bird nesting features to be installed on buildings 9, 10, 11, 17 and 18; • The installation of a Barn Owl box at a suitable location around the site; • Details (including specifications and location) of at least one insect house to be installed on the completed site. • An Implementation Timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with paragraphs 187 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017.
Prior to the commencement of development hereby permitted, a Lighting Design Strategy for Biodiversity shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall be based on Guidance Note 08/23. Bats and Artificial Lighting at Night, by the Bat Conservation Trust and ILP, and shall: • Identify those areas/features on site that are particularly sensitive for nocturnal wildlife and that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example, for foraging; and • Show how and where external lighting will be installed and impacts of internal light spill so that it can be clearly demonstrated that areas to be lit will not disturb or prevent nocturnal animals from using their territory or having access to their breeding sites and resting places. This will include the provision of dark corridor conditions for retained trees, hedgerows and other commuting routes. All lighting shall be installed in accordance with the specifications and locations set out in the strategy and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and to minimise impacts on protected species in accordance with SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Before the commencement of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include: • the overall predicted energy requirements of the approved development; • the predicted energy generation from the proposed renewable/low carbon energy measures; and • an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details. Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No development shall commence until a Risk Assessment and Method Statement (RAMS) for all works to be undertaken within 10m of the operational railway has been submitted to and approved in writing by the Local Planning Authority. The assessment shall demonstrate: a) safe methods of working having consideration to the Network Rail land and the existing operational railway infrastructure; and b) How no dust or debris would contaminate Network Rail land. Thereafter the approved RAMS shall be strictly adhered to and there shall be no variations to that statement unless otherwise previously approved in writing by the Local Planning Authority. Reason: The approval of a Risk Assessment and Method Statement prior to the commencement of development is fundamental to ensuring that risks to the safety of railway users presented by construction operations are minimised having regard to paragraph 102 of the National Planning Policy Framework.
The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This must include (but is not limited to):- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway, including wheel washing facilities; • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc); • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring; • Vehicle routing; • Construction vehicle site access arrangements; • Mitigation for impacts on residents, businesses, and public transport services; and • Details of any temporary construction accesses and their reinstatement. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved in writing by the Local Planning Authority. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety during construction, having regard to policy SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not commence until detailed drawings of the off-site works including the addition of hardstanding as generally shown on Drawing 25041-02 Rev C, with the addition of pavements to connect the bus stops to the site, have been submitted to and approved in writing by the Local Planning Authority, and the proposed development shall not be brought into use until the works have been constructed in accordance with the approved details, implemented in full and open to public use. The proposed works will be subject to a GG119 compliant Road Safety Audit (RSA). Reason: To ensure the development is provided with a genuine choice of sustainable transport modes and that bus travel is considered a viable and attractive alternative to the private car, having regard to policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the submitted details, no works in connection with site drainage shall commence until a scheme for a surface water drainage strategy, for the ‘Yard 1’ area as indicated in the Proposed Site Plan (10518-201 E), in the proposed development has been submitted to, and approved in writing by the Local Planning Authority. The building and external areas, except for ‘Yard 1’ area are to drain as per existing arrangements. The strategy shall include details of surface water drainage measures, and shall conform with the non-statutory technical standards for SuDS (Defra 2015) and the South Worcestershire Development Plan (2016). The strategy for Yard 1 shall also include attenuation to minimise the risk of flooding elsewhere. The scheme shall provide detailed design drawings for all drainage assets and should include run off treatment proposals for surface water drainage. The scheme should include proposals for informing future occupiers of the arrangements for maintenance of surface water drainage assets. Consideration should be made to ensure that the surface water does not impact the railway boundary. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed scheme. Reason: The agreement of drainage plans for the disposal of surface water prior to the commencement of any drainage works is fundamental to prevent flooding by ensuring surface water run-off is managed to minimise risk of flooding on the development and prevent flooding elsewhere and to ensure appropriate foul drainage in the interests of human health, having regard to policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No development shall take place until the applicant, or their agents or successors in title, has secured and completed a Basic Asset Protection Agreement with Network Rail to manage risks associated with the development and adjoining railway. Reason: To ensure that risks to the safety of railway users presented by construction operations are minimised having regard to paragraph 102 of the National Planning Policy Framework.
No development shall occur until details of the building operations for yard 1 (shown on the Proposed Site Plan 10518-201 E dated September 2025), have been submitted and approved in writing. These details shall include: • Details as to any alterations to ground levels; • De-watering works; • Ground stabilisation works and a slope stability review; • Works to retaining walls; • Maintenance of retaining walls; • Construction and temporary works to facilitate the changes to yard 1. Thereafter the approved building operations shall be strictly adhered to and there shall be no variations to that plan unless otherwise previously approved in writing by the Local Planning Authority. Reason: To prevent harm being caused to the safety and operation of the railway, having regard to the relevant aims and objectives of the National Planning Policy Framework.
The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP), has been prepared in accordance with the approved Biodiversity Gain Plan, submitted to and approved in writing by the Local Planning Authority. It shall be based on the recommendations made in the Biodiversity Net Gain Assessment 2023 / 034 Cii dated 6th October 2025, and shall include: (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the HMMP; (c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and (e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the HMMP have been completed. The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP. Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP. The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990, policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby permitted shall not be first occupied until a full Travel Plan has been submitted to and approved in writing by the Local Planning Authority. The Travel Plan shall include but not be limited to: • details of the staff vehicular site access arrangements when entering and egressing the site; • the identification of targets for trip reduction and modal shift for employees from single occupancy car use to walking, cycling and public transport; • the measures to be implemented to meet these targets including an accessibility strategy to specifically address the needs of residents/staff with limited mobility requirements; • the timetable/ phasing of the implementation of the Travel Plan and its operation thereafter for a minimum period of five years, including the responsible body for each action; • the mechanisms for monitoring and review; • the mechanisms for reporting; • the remedial measures to be applied in the event that targets are not met; • mechanisms to secure variations to the Travel Plan following monitoring and reviews; and • appointment and contact details of a travel plan coordinator. The approved Travel Plan shall be implemented, monitored and reviewed in line with the approved Travel Plan for a minimum period of five years following occupation. In the event of failing to meet the targets within the approved Travel Plan, a revised Travel Plan shall be submitted to and approved in writing by the Local Planning Authority to address any shortfalls and where necessary make provision for and promote improved sustainable forms of access to and from the site. The Plan thereafter shall be implemented and updated in agreement with the Local Planning Authority and thereafter implemented as amended. Reason: To reduce single occupancy car travel and to encourage and promote sustainable and active transport and travel having regard to policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the use of Yard 1 (as shown on 10518-201 E- Proposed Site Plan) for vehicular parking, a scheme including safety measures to prevent vehicle incursion from the parking area impacting upon the safe operation of the railway shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details and any safety measures installed prior to the use of Yard 1. Reason: To prevent harm being caused to the safety and operation of the railway, having regard to the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the development substantially accords with Drawing 10518-201 E (Proposed Site Plan), subject to any minor modifications identified during the highways detailed design process. Reason: To define the permission and to ensure that the development meets the design quality and requirements of the Worcestershire County Council Streetscape Design Guide, and to ensure safe access to the site in the interests of highway safety and public convenience, having regard to policy SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the proposed site access as shown on the Proposed Site Access Drawing 25041 – 02 Revision C (contained within DTA’s Technical Note 02- Response to WCC Highways Comments), has been provided and is open for use by vehicular traffic, where any necessary changes identified during the detailed design process has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure safe access to the site in the interests of highway safety and public convenience, having regard to policy SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the visibility splays shown on Proposed Site Access Drawing 25041 – 02 Revision C (contained within DTA’s Technical Note 02- Response to WCC Highways Comments), have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety, particularly that driver visibility splays and stopping sight distances at the vehicle access are commensurate with the legal speed limit, having regard to policy SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the vehicle parking and turning facilities as shown on the Proposed Site Plan 10518-201 E and 25041-02-TRK-2 (HGV Parking Plan - 16.5m Articulated Vehicle contained within DTA’s Technical Note 02- Response to WCC Highways Comments) have been provided. These areas shall thereafter be retained and kept available for their respective approved use at all times. Reason: To comply with the Council’s parking standards and to ensure safe and suitable access for all, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking to comply with the Council’s adopted cycle parking standards has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To ensure that the development incorporates the required provision for the storage of bicycles, in accordance with policies SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements (a) to (d) below have been complied with: a) Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency’s ‘Land Contamination: Risk Management’ guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place. b) Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. c) The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. d) Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site. Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policy SWDP31 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall be used for use Classes B8, B2 and E(g)(iii) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), and for no other purposes, including any other purposes in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no development which would otherwise be permitted under Classes MA of Part 3 of Schedule 2, shall be carried out. Reason: To define the permission and to enable the Local Planning Authority to exercise control over development in the interests of: preserving the setting of the Listed Building, safeguarding the character and appearance of the development, protecting occupiers amenity, protecting employment facilities and to ensure highway and public safety, having regard to Policies SWDP1, SWDP2, SWDP4, SWDP6, SWDP12, SWDP21, SWDP24 and SWDP25 and the relevant aims and objectives of the National Planning Policy Framework.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP). Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule &A of the Town and Country Planning Act 1990, policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No raw materials, finished or unfinished products, parts, crates, packing materials, equipment or waste shall be stacked, stored or deposited on the site except within the building(s) or within any suitably screened external area(s), the details of which (including location of such external storage area(s), location and heights of any stacking shelves, racks or similar equipment, and siting/design/appearance/height of screening) shall be submitted to and approved in writing by the Local Planning Authority prior to any external storage commencing on site. Reason: To safeguard the visual amenities of the area and setting of listed buildings, and to protect the parking and circulation areas of the site, having due regard to SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
In dealing with this application, the Council has worked with the applicant by seeking further information following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
There is potential for existing roofing panels to contain asbestos. We would advise the presence of asbestos containing materials (ACMs) in the building(s) and any ACMs removed during alterations should be disposed of appropriately such that the development site may not be considered contaminated land under Part 2A at a later date.
The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; Advice about how to prepare a Biodiversity Gain Plan and a template can be found at: https://www.gov.uk/guidance/submit-a-biodiversity-gain-plan.
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts.
The Risk Assessment and Method Statement (RAMS) must ensure that all operations, including the use of cranes or other mechanical plant working adjacent to Network Rail’s property, must at all times be carried out in a “fail safe” manner such that in the event of mishandling, collapse or failure, no materials or plant are capable of falling within 3.0m of the nearest rail of the adjacent railway line, or where the railway is electrified, within 3.0m of overhead electrical equipment or supports.
The developer/applicant must ensure that their proposal, both during construction, and after completion of works on site, does not affect the safety, operation or integrity of the operational railway, Network Rail land and its infrastructure or undermine or damage or adversely affect any railway land and structures. • There must be no physical encroachment of the proposal onto Network Rail land, no over-sailing into Network Rail air-space and no encroachment of foundations onto Network Rail land or under the Network Rail boundary. • All buildings and structures on site including all foundations / fencing foundations must be constructed wholly within the applicant’s land ownership footprint. • Buildings, windows and structures must not over-sail Network Rail air-space/boundary. • Any future maintenance must be conducted solely within the applicant’s land ownership. • Rainwater goods must not discharge towards or over the railway boundary • Should the applicant require access to Network Rail land to facilitate their proposal they would need to approach the Network Rail Asset Protection Team at least 20 weeks before any works are due to commence on site. The applicant would be liable for all costs incurred in facilitating the proposal and an asset protection agreement may be necessary to undertake works. Network Rail reserves the right to refuse any works by an outside party that may adversely impact its land and infrastructure. • Any unauthorised access to Network Rail air-space or land will be deemed an act of trespass
The applicant must ensure that the proposal drainage does not increase Network Rail’s liability, or cause flooding pollution or soil slippage, vegetation or boundary issues on railway land. Therefore, the proposed drainage on site should include the following: • All surface waters and foul waters must drain away from the direction of the railway boundary. • Soakaways for the proposal must be placed at least 30m from the railway boundary. • Any drainage proposals for less than 30m from the railway boundary must ensure that surface and foul waters are carried from site in closed sealed pipe systems. • Suitable drainage or other works must be provided and maintained by the developer to prevent surface water flows or run-off onto Network Rail’s land and infrastructure. • Drainage works must not impact upon culverts, including culverts/brooks etc that drain under the railway. • The developer must ensure that there is no surface or sub-surface flow of water towards the operational railway. • Rainwater goods must not discharge in the direction of the railway or onto or over the railway boundary.
Properties adjoining or in the vicinity of the railway are frequently the subject of obligations, rights, exceptions and reservations for the benefit of Network Rail’s land and railway. The applicant must review the title to their property to see whether any such obligations etc exist and ensure that there is no non-compliance or breaches of them or any interference with or obstruction of Network Rail’s rights and reservations. If the proposed development would not comply with or would breach any of the terms of the conveyance, the developer must revise his proposals.
Fire Service Vehicle access should comply with the requirements of ADB 2019 Vol. 2 B5, section 15 & Table 15.1 with regards the proposed floor area, height of the building and type of fire appliance. Access road to be in accordance with ADB 2019 Vol. 2 Table 15.2 with regards access widths and carrying capacity Water for firefighting purposes should be provided in accordance with section 16 and National guidance document on the provision of water for fire - fighting and BS 9990.
