| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available nor was pre-application advice sought prior to its submission. As a result the Council has been unable to seek solutions to problems arising from this application as the amendments required to make the application acceptable are substantial and are considered to materially change the development proposals. They would require further consultation to be undertaken prior to determination which could not take place within the statutory determination period specified by the Ministry of Housing, Communities & Local Government. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application. |

| By virtue of the design, scale and massing of the proposed extension, the development would have an unacceptable visual impact on the host dwelling and the street scene. The proposed development would not represent high quality design that would integrate effectively with the host dwelling and its surroundings, with the proposed extensions creating a visually dominate and incongruous feature. The proposal is therefore contrary to Policy SWDP21 of the South Worcestershire Development Plan, NPPF and the principles of the Design Guide SPD. |
| In light of the fact 24 Cheltenham Road has a half glazed door and window on the north-east side elevation facing the application site, which serves a utility room, and given the size, scale and siting of the proposal close to the south-west boundary of the application site, the proposal will significantly overshadow and result in a loss of light and outlook for this window. Furthermore, the proposed window on the south-west elevation of the extension will be directly opposite this half glazed door and window, resulting in a loss of privacy for 24 Cheltenham Road. Therefore the development would significantly impact the residential amenity of existing neighbouring development. As such, the proposal fails to comply with policies SWDP21 of the South Worcestershire Development Plan 2016, as well as the provisions of the NPPF. |
| The submitted Flood Risk Assessment does not set out details in regard to the finished floor levels of the proposed development, details of flood resistance and resilience plans and details of sustainable drainage systems. As such the application fails to demonstrate that it will minimise the impacts of and from all forms of flood risk. The proposal would therefore be contrary to Policy SWDP28 of the South Worcestershire Development Plan as well as Policy SB3 of the Sedgeberrow Parish Neighbourhood Plan. |
