| The development hereby permitted shall be carried out in strict accordance with the recommendations set out in evaluation and conclusions of the Daytime Bat Survey report by Betts dated May 2019. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017. |
| The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling within the red line site location plan as submitted with this application currently known as Barn Adjacent to Pipestyle House. The development shall not be used as an independent self contained dwelling separate from the dwelling known as Barn Adjacent to Pipestyle House. Reason - As a separate dwelling house in this location would not represent sustainable development and be contrary to the development location strategy set out in policy SWDP2 of the South Worcestershire Development Plan. |
| ? The safety of the public using the rights of way is to be ensured at all times. ? The route of public rights of way should be marked on the Block Plans, Location Plans and any other plan submitted to the Council, as per standard practice and in the interests of public safety. “All public rights of way crossing or adjoining the proposed development site must be marked on the plan to be submitted with the full planning application.”1 The working copy of the Definitive Map can be found at Public Rights Of Way | Worcestershire County Council. The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown. ? Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. ? The definitive line of public rights of way should be kept open and available for use throughout the construction phase. However, if public safety demands a temporary closure, application should be made at least 6 weeks in advance to: the Public Rights of Way Mapping Team at Worcestershire County Council prowclosures@worcestershire.gov.uk. ? There must be no disturbance of, or change to, the surface of the paths or part thereof without the written consent of the PROW team (this includes laying concrete, tarmac or similar). The County Council is responsible for maintaining rights of way only to a standard suitable for their usual public use. Therefore any damage to the surface of the PRoW and repairs of such must adhere to Highway Authority specifications. ? The grant of planning consent does in no way entitle developers to obstruct a public right of way. ? Under section 34 of the Road Traffic Act 1988, any person who drives a motor vehicle on a public right of way, without lawful authority, commits an offence. ? No additional barriers can be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. ? There must be no diminution in the width of the rights of way available for use by the public. |
| The roof tiles of the outbuilding hereby permitted shall be constructed in Tapco/slate Plum code 706 Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan. |
| The asbestos cement sheeting should be removed in an appropriate manner and care taken to avoid breaking up the sheeting to reduce the risk of fibre release. Sheets should be double wrapped with polythene sheeting and sealed using tape before being disposed of to a suitably licensed landfill facility. |
| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
