| Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference W/24/01673/CLPU registered on 20/08/2024 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and on the plan attached to this Notice, as the matter described in the First Schedule to this Notice would not be lawful as at the 20/08/2024 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- That the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended) thus requiring planning permission, because:- 1. The proposed repositioning of the boundary would not constitute 'Permitted Development' under Schedule 2, Part 2, Class A of the Town and Country (General Permitted Development) (England) Order 2015 (as amended). Whilst the repositioned boundary treatment(s) would not be adjacent to a highway and would not involve the development within the curtilage of, or to a gate, fence, wall or other means of enclosure surrounding, a listed building, no evidence has been submitted to demonstrate that the height of the boundary treatment would not exceed 2m. As such, the development as proposed fails to comply with paragraph A.1(b) of Class A to Part 2. 2. The use of the land as domestic garden in relation to residential dwellings along Gravel Pits Close would be a change of use of the land from Class E to C3. There is no permitted change from Class E use to C3 use in this manner under Schedule 2, Part 3 of the Town and Country (General Permitted Development) (England) Order 2015 (as amended) and therefore planning permission is required for this change of use of the land. |
