Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 and the National Planning Policy Framework. |
| No building above slab level shall commence until details of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:-
- type, colour, of brickwork or render to be used in external facing elevations
- type, colour, texture, size and design of roofing materials;
-details of hardstandings
-details of boundary treatments
The development shall be carried out in accordance with the approved details.
Reason: To ensure that the new materials and details are in keeping with the surroundings and represent quality design in accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016.

| The dwellinghouses hereby approved shall not be occupied until visibility splays are provided from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 2 metres in each direction measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.
Reason: In the interests of highway safety in accordance with comply with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 and the Worcestershire County Council Streetscape Design Guide, July 2022.

| The dwellinghouses hereby approved, shall not be occupied until the vehicular access at Newland Lane, as shown on amended plan reference A1130-02 entitled ‘Planning Layout’, has been widened to a minimum width of 5.5 metres and the private drive provided at a minimum width of 5.0 metres, to the written satisfaction of the Local Highway Authority.
Reason: To ensure safe and adequate access can be obtained in the interests of highway safety and in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016

| No development shall commence until a full drainage strategy including detailed design drawings and calculations for surface water and foul water drainage based on infiltration testing and the use of package sewage treatment plants has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details and the approved facilities shall be retained operational.
Reason: To ensure that the site is adequately drained and provides drainage solution in accordance with Policy SWDP28 and SWDP29 of the South Worcestershire Development Plan,2016 to reduce the risk of creating or exacerbating a local flooding problem and to minimise the risk of pollution.

| No dwelling hereby approved shall be occupied until provision shall be made within the site for the sustainable disposal of surface water / inclusive of SUDS.
Reason: To dispose of surface water and prevent discharge onto the highway, in the interests of highway safety in accordance with comply with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan.

| The recommendations and precautionary measures for protection set out within Sections 4.1 and 4.b of the Phase I Preliminary Ecological Appraisal, September 2023 revised Nov 2023 by Focus Environmental Consultants submitted with the application shall be followed at all times during site clearance, demolition and construction.
Reason: To safeguard protected species and provide biodiversity enhancements in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with Wildlife and Countryside Act 1981 and Conservation of Habitats and Species Regulations 2017.

| The dwellinghouses hereby approved shall not be occupied until its associated car parking provision and vehicle turning space as generally shown on amended plan reference A1130-16 Rev A entitled ‘Planning Layout’ entitled ‘Planning Layout’ has been implemented. This area shall thereafter be retained for the purpose of parking a vehicles only.
Reason: In the interests of highway safety and to ensure adequate parking to comply with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 and the Worcestershire County Council Streetscape Design Guide, July 2022.

| The dwellinghouses hereby approved, shall not be occupied until one bird box and one bat box has been provided for each dwelling in accordance with the recommendations set out within the Phase I Preliminary Ecological Appraisal, September 2023 revised Nov 2023 by Focus Environmental Consultants.
Reason: To provide biodiversity enhancements in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016.

| Prior to the commencement of the development hereby approved, including the removal of any structures on the site, the existing trees, shrubs and hedges on the site shall be protected by fencing constructed in accordance with BS 5837:2012 (trees in relation to design, demolition and construction - recommendations) in accordance with the plan reference 3039-P-11 Tree Protection Plan within the ‘BS5837:2012 Arboricultural Survey & Impact Assessment’ Version 2 dated 19 October 2024 (Focus Environmental Consultants). These protection measures will be retained throughout the development of the site in the approved positions.
Reason: To protect the existing trees on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan, 2016.

| The removal of the structure at the site shall be removed in accordance with the tree protection method statement within ‘BS5837:2012 Arboricultural Survey & Impact Assessment’ Version 2 (Focus Environmental Consultants) dated October 2024.
Reason: To protect the existing trees on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan, 2016.

| The dwellinghouse hereby approved, shall not be occupied until a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, 2016.

| The dwellinghouse hereby approved, shall not be occupied until details of renewable and/or low carbon energy generation measures are submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
i. the overall predicted energy requirements of the approved development;
ii. the predicted energy generation from the proposed renewable/low carbon energy measures; and
iii. an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan,2016.

| Prior to the installation of any external lighting, details of such external lighting shall be submitted to and approved in writing by the Local Planning Authority. All lighting should be designed in accordance with Bat Conservation Trust / Institution of Lighting Professionals Guidance Note 08/18 Bats and artificial lighting in the UK. Submitted lighting plans should be accompanied by contour diagrams that demonstrates minimal levels of lighting on receptor habitats, including trees and hedges. Development shall be carried out in accordance with the approved details and retained thereafter.
Reason: To safeguard protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with Wildlife and Countryside Act 1981 and Conservation of Habitats and Species Regulations 2017.

| Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking or re-enacting that order), no development (as defined by Section 55 of the Town and Country Planning Act 1990) as may otherwise be permitted by virtue of Class A, Class B, Class C or Class E of Part 1, Schedule 2 of the Order or Classes A or B of Part 2, Schedule 2 of the Order shall be carried out on the dwellinghouses hereby permitted.
Reason: To protect, conserve and enhance the character of the area in accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016.

| Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
| Buildings are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994, the latter of which deems them a European Protected Species.
It is a criminal offence to recklessly disturb or destroy a bat 'roost'. Where a bat 'roost' is present a licence might be necessary to carry out the works. Further information about species licensing and legislation can be obtained from the Species Licensing Service on 0117 3728000. If evidence of bats is found during works, work should stop immediately and Natural England must be contacted on 01453 764450 for advice on the best way to proceed. |
| Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible.
However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts. |
