Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 22/01214/FUL, dated 04.08.2023. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Drawing No. 6040/P1-02 B (Plot 1 Proposed Ground Floor Plan) Drawing No. 6040/P1-04 B (Plot 1 Proposed First Floor Plan) Drawing No. 6040/P1-06 B (Plot 1 Proposed Elevations) Drawing No. 6040/901 (Plot 1 Proposed Site Plan) Drawing No. 6040/902 (Plot 2 Proposed Site Plan) Drawing No. 6040/P2-02 D (Plot 2 Proposed Ground Floor Plan) Drawing No. 6040/P2-04 C (Plot 2 Proposed First Floor Plan) Drawing No. 6040/P2-06 B (Plot 2 Proposed Elevations) Approved plans/drawings/documents Ref: 22/01214/FUL: 2022 001 Location Plan 2022 0 100 Plot 1 Details 2022 0 100 b Proposed Site Plan 2022 2 100 b Plot 2 Details Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The materials shall be implemented in accordance with details approved in the conditions letter dated 6 September 2024 (Ref: W/24/01321/CCO) for planning permission Ref: W/22/01214/FUL. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP4, SWDP21 and SWDP24 of South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The dwellings hereby approved shall not be occupied until the vehicular access and turning areas shown on Drawing 6040/901 have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. Reason: In the interests of highway safety in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Drainage arrangements shall be provided to ensure that surface water from the shared driveway and vehicular turning areas does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway. Reason: In the interests of highway safety in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the nearside edge of the adjoining carriageway has been surfaced in a bound material. Reason: In the interests of highway safety in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Any new entrance gates shall be set back 5 metres from the adjoining carriageway edge and shall be made to open inwards only. Reason: In the interests of highway safety in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
No dwelling hereby approved shall be first occupied until an area has been laid out within the curtilage of the dwelling for the parking of 3 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The measures set out in the Construction Environmental Management Plan (CEMP) shall be implemented in accordance with details approved in the conditions letter dated 6 September 2024 (Ref: W/24/01321/CCO) for planning permission Ref: W/22/01214/FUL. Reason: To ensure the provision of adequate on-site facilities in the interests of highway safety in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted BK Development Sustainability Statement July 2021 shall be fully implemented and shall remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan showing the layout of proposed tree, hedge and shrub planting and grass areas. (ii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iii) a written specification outlining cultivation and other operations associated with plant and grass establishment. (iv) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordace with Policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
No dwelling here by approved shall be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted cycle parking standards has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards and policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The Development hereby approved shall not be occupied until details of the proposed boundary treatments including any gates, walls or fences shall be submitted to and approved in writing by the local planning authority. The approved boundary treatments shall be implemented in accordance with approved details and retained in perpetuity. Reason: In in the interest of visual amenity and the amenities of adjacent properties and to comply with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The flat roof area of of the garage as shown at at plot no.1 shall not be used as a balcony or sitting out area and there shall be no access to the roof area. Reason: In the interest of the amenities of the adjacent properties and to comply with Policy SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to above ground works, samples and full particulars of all external facing materials to be used in the construction of the garages shall be submitted to and approved in writing by the Local Planning Authority. The details to be submitted shall include:- - A precise specification of the proposed tiles, bricks and/or external render or plaster – including any decorative panels or patterns; - details of external doors/windows; - details of any external rainwater goods, flues, grilles, louvres and vents. The development shall not be carried out other than in accordance with the approved details. Reason: To ensure a satisfactory external appearance of the development and that high quality materials and finishes are used, in accordance with policies SWDP6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Alterations of highway to provide a new vehicle crossover to the footway/verge. This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
