Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission with reference 21/00636/TDC5 which was approved on the 22nd February 2023. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Drawing 21939 100 Rev B – Location Plan Drawing 21939 101 Rev B – Block Plans Existing and Proposed Drawing 21939 102 – Site Plan Colour Drawing 21939 103 – House 1 Ground Floor Drawing 21939 104 – House 1 First Floor Drawing 21939 105 – House 2 Ground Floor Drawing 21939 106 – House 2 First Floor Drawing 21939 107 – House 1 North and South Elevations Drawing 21939 108 – House 1 East and West Elevations Drawing 21939 109 – House 2 North and South Elevations Drawing 21939 110 – House 2 East and West Elevations Drawing 21939 111 – Site Plan Including Access Reason: To define the permission.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal report carried out by CSA Environmental dated February 2021 and submitted with this application. In particular: - Precautionary construction avoidance measures for nesting birds, reptiles and great crested newts. - Ecological enhancement measures including new native hedge and tree planting, new roosting, nesting and invertebrate provisions, and hedgehog gaps. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
No building hereby permitted shall be occupied until the implementation of the sustainable drainage/surface water drainage scheme as shown on the following approved plans and documents has been carried out and available for use: • 2267: Drainage survey undertaken on 28/08/2024 • 2255: Drainage survey undertaken 25/04/2024 • klargester-biodisc-ba-bc-brochure-2024-en-gb.pdf: brochure • AG-LINK-XX-DR-C-0502-Drainage Construction Details.pdf: Construction details • AG-LINK-XX-DR-C-0501-Drainage Details.pdf: Drainage details • AG-LINK-XX-DR-C-0500-Proposed Drainage Layout.pdf: Drainage plan The drainage scheme shall be thereafter managed and maintained in accordance with the above details. Maintenance and management details of the sustainable drainage/surface water drainage scheme shall be submitted to and approved in writing by the local planning authority prior to the first occupation of the development hereby permitted. Details shall include: - an implementation timetable; and - a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public body or statutory undertaker, or any other arrangements to secure the operation of the drainage scheme throughout its lifetime. The drainage scheme shall be implemented and thereafter managed and maintained in accordance with the approved details. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.

The Development hereby permitted shall not be first occupied until the proposed / dwellings have been fitted with an electric vehicle charging point. The charging points shall comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 and the Worcestershire County Council Streetscape Design Guide. The electric vehicle charging points shall be retained for the lifetime of the development unless they need to be replaced in which case the replacement charging point(s) shall be of the same specification or a higher specification in terms of charging performance. REASON: To encourage sustainable travel and healthy communities in accordance with SWDP4.
The development hereby permitted shall be carried out in accordance with the following details approved under application 21/00636/TDC5 on the 9th February 2024: - Drawing no: AG-DH-ST P02 Rev P1, Dated 09/10/2023. The approved cycle parking shall be kept available for the parking of bicycles only thereafter. Reason - To comply with the Council’s parking standards and ensure sustainable travel in accordance with SWDP4.
The Development hereby approved shall not be occupied until the access, parking and turning facilities have been provided as shown on Drawing 21939 / 111 (-). Reason: To ensure conformity with submitted details and ensure highways safety in accordance with SWDP4.
The development hereby permitted shall be carried out in accordance with the following details approved under application 21/00636/TDC5 on the 24th May 2024: - Email from R Verma to S Hill dated 10/05/2024; - Email from A Tucker to A Ahmadi dated 10/05/2024; - Letter to A Ahmadi from A Tucker dated 10th May 2024; - Drawing no: 23121-C-550 Rev I – 10.05.24; - Drawing no: 23121-C-551 Rev E – 02.05.24; - Drawing no: 23121-C-552 Rev D – 10.05.24; - Drawing no: 23121-C-553 Rev H – 08.05.24. REASON: To ensure the safe and free flow of traffic onto the highway in accordance with SWDP4.
The development hereby permitted shall be carried out in accordance with the following details approved under application 21/00636/TDC5 on the 9th February 2024: - Drawing no: AG-DH-CMP P01 Rev P1, Dated 09/10/23. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with SWDP4.
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway works with the Highway Authority, nor does it confirm acceptance of the proposal by the Highway Authority until that design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow conditions imposed under this permission to be discharged, but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into and the applicant has complied with the requirements of the Traffic Management Act 2004. The applicant is urged to engage with the Highway Authority as early as possible to ensure that the approval process is started in a timely manner to achieve delivery of the highway works in accordance with the above-mentioned conditions. The applicant should be aware of the term “highway works” being inclusive of, but not limited to, the proposed junction arrangement, street lighting, structures and any necessary traffic regulation orders.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions - seeking the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
