| By virtue of the size and scale of the extension, as well as the facing materials using brickwork which does not match the main dwelling, the proposal would appear as an undully dominant and incongrous feature withihn the street scene and would not appear as a subservient addition to the host dwelling. The proposed development would harm the character and appearance of the area. Accordingly, it would be contrary to Policy SWDP21 of the South Worcestershire Development Plan 2016, Policies NCD1 and NCD2 of the North Claines Neighbourhood Plan, the South Worcestershire Design Guide Supplementary Planning Document and paragraph 130 of the Framework. These policies seek to ensure that new development integrates effectively with its surroundings. |
| The extension as built would result in adverse impacts in terms of overlooking of a first floor side elevation window at the neighbouring property 220 Droitwich Road from the large rear window and Juliet balcony of the extension. Accordingly, the proposal would cause unacceptable impacts on the living conditions of this neighbouring property and therefore the development would be contrary to Policy SWDP21 of the South Worcestershire Development Plan 2016, the South Worcestershire Design Guide Supplementary Planning Document and paragraph 130 of the Framework. |
| The extension will result in insufficient parking provision for the dwelling, failing to meet the requirements of policies SWDP4 of the South Worcestershire Development Plan and the County Council Parking Standards, and NPPF paragraph 116. The lack of parking would cause detriment to pedestrian use of the pavement on Droitwich Road frontage due to likelihood of parking on the pedestrian area which would likely result in adverse highway safety harm, contrary the Policy SWDP4 of the South Worcestershire Development Plan and Paragraph 115 of the NPPF. |
| The application made is to vary conditions to planning permission ref: 17/00307/HP however, no evidence supports the assertion that the development commenced within the time period of three years which would have expired on 25/05/2020.. As such, it is not considered that a variation of condition application is an appropriate way to regularise the retrospective development. |

| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available and due to the retrospective nature of the development the Council has been unable to seek solutions to problems arising from this application. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. |
