Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Site Location Plan - Received 16.10.24 Block Plan - Received 16.10.24 Block Plan (Showing trees) - Received 16.10.24 Cross Section 05 - Received 16.10.24 Base Plan 01 Rev A - Received 07.01.25 Front and Rear Elevations 06 Rev A - Received 07.01.25 Gable Elevations 07 Rev A - Received 07.01.25 Roof Plan 02 Rev A - Received 07.01.25 Application Form – listed materials and finishes Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Before the commencement of construction works on the development hereby permitted, details of a bat roosting feature [and / or bird nesting box] shall be submitted to and approved in writing by the Local Planning Authority.  The details to be submitted shall include an implementation timetable. The feature(s) shall be provided in accordance with the approved details and in accordance with the approved timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to their installation, details of any external lighting shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Planning Statement (Oct 2024) in relation to surface water drainage (Para 22) shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Prior to the first use of the development hereby permitted details of the long-term maintenance, management and monitoring of the Biodiversity Net Gain provision detailed within the Preliminary Ecological Appraisal & Biodiversity Net Gain Assessment (Sharpe Ecology) (Dec 2024) shall be submitted to and approved in writing by the Local Planning Authority. The submitted details shall cover a thirty-year period. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and the wider in accordance with policy SWDP22 of the South Worcestershire Development Plan 2016.
The development hereby permitted shall be carried out in strict accordance with the following recommendations contained within: - Preliminary Ecological Appraisal & Biodiversity Net Gain Assessment (Sharpe Ecology) (Dec 2024) The Biodiversity Net Gain (BNG) listed in the document above shall be completed prior to the first use of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and provides at least 10% biodiversity net gain at the site.
Notwithstanding the provisions of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015,(or any order revoking or re-enacting that Order with or without modification), no development which would otherwise be permitted under Classes Q, R and S of Part 3 of Schedule 2, shall be carried out. Reason: In the interests of sustainable development and in order to protect the character and amenity of the locality, to maintain the amenities of adjoining property and to comply with Policies SWDP1, SWDP2, SWDP4 and SWDP24 and the National Planning Policy Framework.
No development shall take place which obstructs the existing public right of way crossing the application site until an order has been made for it to be diverted or stopped up. Reason - To ensure the public right of way is not obstructed in accordance with SWDP21 and the aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
The following general obligations to Public Rights of Way must be observed: • The Public safety of those using the right of way must be ensured at all times. • There must be no diminution in the width of the rights of way available for use by the public. • There must be no change to the surface of a Public Right of Way without written consent from the authority. • Building materials must not be stored on the rights of way. • Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. • No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority
