Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. REASON: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information detailed on the attached Reports and Plans Schedule Dated May 2025. Reason: In order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. (B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. REASON: In accordance with the requirements of paragraphs 200 and 211 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016.
No building hereby permitted shall be occupied until details of the design, implementation, maintenance and management of sustainable urban drainage/surface water drainage works have been submitted to and approved in writing by the local planning authority. The submitted details shall: a) provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; b) include a timetable for its implementation; and c) provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details. REASON: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
No works or development shall take place until a construction surface water management plan has been submitted to and approved in writing by the Local Planning Authority. The plan shall include how surface water will be managed during the construction phase, including site clearance, soil stripping and pond amendments. The plan shall include drawings of any temporary drainage systems, a timeline of construction and measures to mitigate the risk of pollution (including silt) of the water environment and offsite flood risk. The plan shall detail how the approved permanent surface water drainage system shall be remediated during the construction phase. The approved construction surface water management plan shall be implemented as soon as works start on site thereafter maintained during the full duration of the construction phase. REASON: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
Prior to the commencement of development an updated Ecological Management and Monitoring Plan shall be submitted to and approved in writing by the Local Planning Authority. The updated plan shall be based on the latest set of landscape and planting plans and include appropriate management and maintenance prescriptions as well as recommendations for future monitoring and adaptive management over the 30 years. Each field survey monitoring report (carried out in scheme years 1, 3, 5, 10, 15, 20, 25 and 30) shall be submitted to the Local Planning Authority, and any revisions to the EMMP shall be first approved in writing by the Local Planning Authority. The approved details shall be implemented thereafter. REASON: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity in accordance with Policy 22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc). • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • construction traffic routing plan • Details of any temporary construction accesses and their reinstatement. Details of how the existing school shall be kept open and how students, staff and visitors will be managed, in terms of avoiding conflict with construction traffic and the construction works. • Temporary traffic management requirements on Station Road. • A highway condition survey, timescale for re-inspections, and details of any reinstatement. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the local planning authority. REASON: To ensure the provision of adequate on-site facilities and in the interests of highway safety and compliance with Policy SWDP04 of the South Worcestershire Development Plan.
No demolition shall take place until the Bat Barn has been completed in accordance with the details hereby approved. REASON: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan.
Prior to the commencement of any above ground works on the new building hereby permitted, details of the form, colour and finish of the materials to be used externally on the walls and roofs of the building hereby approved shall be submitted to and approved in writing by, the Local Planning Authority. The building shall be constructed in the materials so approved and retained in that form. REASON: To ensure that the development is visually satisfactory and appropriate to its context in accordance with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No works in connection with site drainage shall commence until a surface water drainage strategy for the proposed development has been submitted to, and approved in writing by the Local Planning Authority. The strategy shall include details of surface water drainage measures, including for hardstanding areas, and shall conform with the non-statutory technical standards for SuDS (Defra 2015) and shall include the results of an assessment into the potential of disposing of surface water by means of a sustainable drainage system (SuDS) and the Drainage strategy (SRP1031-NOL-01-ZZ-T-C-0027 v.P04). The scheme shall provide detailed design drawings for all drainage assets. Exceedance flows should not be directed to property or private land. Where the scheme includes surface water drainage assets, proposals for dealing with the future maintenance of these assets should be included. The scheme should include proposals for informing future occupiers of the arrangements for maintenance of communal surface water drainage assets. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed scheme. REASON: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. REASON: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
No development shall take place until a remediation scheme for the mitigation of the identified asbestos within the shallow Made Ground in a landscaped area in the west of the site has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include; 1. A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. 2. The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development, other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. 3. Following the completion of the measures identified in the approved remediation scheme a validation report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings. 4. In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where necessary a remediation scheme must be prepared, these will be subject to the approval of the Local Planning Authority. Following the completion of any measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to the occupation of any buildings. The scheme shall be carried out in accordance with the approved mitigation thereafter. REASON To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Unless otherwise agreed by the Local Planning Authority development, other than that required to be carried out as part of an approved scheme of remediation, must not commence until the following 4 requirements have been complied with. a. Full details of any soil or soil forming materials proposed for importation to the site for use in garden areas, soft landscaping, filling, and level raising shallbe submitted to the Local Planning Authority and approved in writing prior to import and implementation of the scheme. The material must be assessed for contamination and suitability for use on site. Full donor site details, proposals for contamination testing; including testing schedules, sampling frequencies and allowable contaminant concentrations (as determined by appropriate risk assessment), must be submitted to and approved in writing by the Local Planning Authority prior to import on to the site. Following implementation of the approved scheme suitable validatory evidence (including but not exclusive to laboratory certificates, photographs, consignment notes, and relevant risk assessment) should be submitted to and approved in writing by the Local Planning Authority. All works are to be carried out by competent persons and in accordance with the Environment Agencies ‘Land Contamination Risk Management’ guidance (LCRM). Reason To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
The building shall not be occupied until a scheme for the removal of the contractors' compound, parking areas and access route and the reinstatement of the Playing Field and planting areas has been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be carried out thereafter in complete accordance with a restoration timetable that has been agreed as part of the restoration scheme. REASON: To ensure the site is restored to a condition fit for purpose and to accord with South Worcestershire Development Plan Policies SWDP05 and SWDP25 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be first occupied until a Travel Plan has been submitted using Modeshift STARS Business and ‘Approved’ level accreditation achieved and been confirmed by the Local Planning Authority. ‘Good’ level accreditation must be achieved and confirmed by the Local Planning Authority within 12 months of first occupation and the Travel Plan thereafter shall be implemented and monitored in accordance with the regime contained within the Plan. In the event of failing to meet the targets within the Plan, a revised Plan shall be submitted to and approved in writing by the Local Planning Authority to address any shortfalls and, where necessary, make provision for and promote improved sustainable forms of travel to and from the site. The submitted details shall use Modeshift STARS Business to carry out this process and include mechanisms for monitoring and review over the life of the development and timescales for implementation. REASON: To ensure residents of the development site are offered a genuine choice of sustainable travel modes, to promote sustainable access to the development site and to comply with Policy SWDP04 of the South Worcestershire Development Plan.
Within 6 months of first occupation, a noise verification report shall be submitted to and approved in writing by the Local Planning Authority. The report shall include the results of monitoring the new plant equipment and the method by which the results were gathered. If the results establish that noise levels exceed the background noise levels stated in the submitted Noise Report, and nearby receptors are adversely impacted, further mitigation will need to be agreed in writing with the Local Planning Authority and the monitoring and reporting process undertaken again. REASON: In the interests of the residential amenities of surrounding dwellings and to ensure compliance with Policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the completion of the development OR in accordance with the submitted implementation programme. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. REASON: To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site in accordance with South Worcestershire Development Plan policy SWDP 25.
The development shall be carried out in complete accordance with the recommendations and mitigation measures contained within the Preliminary Bat Roost Assessment. No demolition or works to any building included in the recommendations shall take place until the mitigation measures outlined have been completed. REASON: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in complete accordance with the approved Construction Ecological Management Plan (CEcMP) dated September 2024 and all of the mitigation measures outlined within it. REASON: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with Policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Ecological Management and Monitoring Plan (EMMP). It shall be supported by an updated BNG Assessment which is based on the most recent planting and landscape proposals. REASON: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity in accordance with Policy SWDP 22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
ARCHAEOLOGY A fee is chargeable for the provision of archaeological curatorial services. The service includes advice and liaison throughout the archaeological works, including the provision of a brief (if requested), checking the Written Scheme of Investigation for compliance with local and national standards, monitoring fieldwork and ensuring any archaeological reports generated by the project are acceptable. The Archaeology and Planning Advisor will be happy to offer advice on all stages of the proceedings. Additional site visits will be chargeable at £60 per visit if required if it is considered that breaches of condition have taken place or when other situations arise that require a visit additional to the usual service. As this scheme is considered to be a medium-scale development of more than 1-ha the fee for curatorial services will be £600.00 (Inc VAT).
HIGHWAYS Alteration of highway This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access. Works Adjoining Highway Any work involving the removal or disturbance of ground or structures supporting or abutting the publicly maintained highway should be carried out in accordance with details to be submitted to and approved in writing by the Highway Authority. Construction Traffic Management Plan (CTMP) It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but reference is made to "respecting the community" this says:- Constructors should give utmost consideration to their impact on neighbours and the public • Informing, respecting, and showing courtesy to those affected by the work. • Minimising the impact of deliveries, parking, and work on the public highway. • Contributing to and supporting the local community and economy. • Working to create a positive and enduring impression and promoting the Code. The CEMP should clearly identify how the principal contractor will engage with the local community. This should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues. Contractors should ensure that courtesy boards are provided, and information shared with the local community, relating to the timing of operations and contact details for a site coordinator in the event of any difficulties. This does not offer any relief to obligations under existing Legislation.
LLFA Please note that any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded. The applicant should be aware that polluting the nearby watercourse, for instance by allowing the discharge of sediment rich runoff from the construction site, might constitute an environmental offence. The applicant is expected to fully assess the risks from all pollution sources and pathways and take sufficient precautionary measures to mitigate these risks for this development.
BNG The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; (d) Any registered off-site biodiversity gain allocated to the development and the biodiversity value of that gain in relation to the development; (e) Any biodiversity credits purchased for the development, and (f) Such other matters as the Secretary of State may by regulations specify. Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
