Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Drawing No.737-1-200B (Plans & Elevations) Preliminary Ecological Appraisal & Biodiversity Net Gain Assessment prepared by ‘Sharpe Ecology’ (dated December 2024) Baseline Habitat Map (dated December 2024, Version 1.0) Proposed Habitat Map (dated December 2024, Version 1.0) Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The development shall not commence until a Habitat Management and Monitoring Plan (HMMP), prepared in accordance with the approved Proposed Habitat Map (dated December 2024 Version 1.0) is submitted to include the following details; (a) a non-technical summary; (b) the roles and responsibilities of the people or organisation(s) delivering the HMMP; (c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; (d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development. The details must be approved in writing by the local planning authority. Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the approved HMMP have been completed. Reason: To ensure an overall improvement to biodiversity in accordance with Policy SWDP 22 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework, and Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021).
Prior to above ground works, samples and full particulars of all external facing materials to be used in the construction of the development shall be submitted to and approved in writing by the Local Planning Authority. The details to be submitted shall include:- - A precise specification of the proposed timber boarding – including colours, textures and any decorative panels or patterns; - details of roofing material; - details of any external rainwater goods, flues, grilles, louvres and vents. The development shall not be carried out other than in accordance with the approved details. Reason: To ensure a satisfactory external appearance of the development and that high quality materials and finishes are used, in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
The development hereby approved and land edged red and blue as shown on Drawing No.737-1-200B (Plans & Elevations) listed under Condition 2 of this Decision Notice shall not be sold. Let, or sublet separately from each other Reason – In the interests of sustainable development, to avoid piecemeal and unrelated development in the countryside and to comply with Policies SWDP1, SWDP2, SWDP4, and SWDP12 and the relevant aims and objectives of the National Planning Policy Framework
Notwithstanding the provisions of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015,(or any order revoking or re-enacting that Order with or without modification), no development which would otherwise be permitted under Classes Q, R and S of Part 3 of Schedule 2, shall be carried out. Reason: In the interests of sustainable development and in order to protect the character and amenity of the locality, to maintain the amenities of adjoining property and to comply with Policies SWDP1, SWDP2, SWDP4 and SWDP24 and the National Planning Policy Framework.
