| The development hereby permitted shall not be open to customers outside the following hours of :
08:00 - 18:00 Monday - Saturday and 10:00 - 16:00 Sunday and Bank Holidays.
Deliveries to, and collections from, the development shall also not be made outside of these hours.
Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Unless otherwise agreed by the Local Planning Authority development, other than that required to be carried out as part of an approved scheme of remediation, must not commence until conditions 1 to 5 have been complied with:
1. A preliminary risk assessment (a Phase I desk study) submitted to the Local Authority in support of the application has identified unacceptable risk(s) exist on the site as represented in the Conceptual Site Model. A scheme for detailed site investigation must be submitted to and approved in writing by the Local Planning Authority prior to being undertaken to address those unacceptable risks identified. The scheme must be designed to assess the nature and extent of any contamination and must be led by the findings of the preliminary risk assessment. The investigation and risk assessment scheme must be compiled by competent persons and must be designed in accordance with the Environment Agency's "Land Contamination: Risk Management" guidance.
2. The detailed site investigation and risk assessment must be undertaken in accordance with the approved Scheme and a written report of the findings produced. This report must be approved by the Local Planning Authority prior to any development taking place.
3. Where the site investigation identified remediation is required, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
4. The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development, other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
5. Following the completion of the measures identified in the approved remediation scheme a validation report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings.
6. In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where necessary a remediation scheme must be prepared, these will be subject to the approval of the Local Planning Authority. Following the completion of any measures identified in the approved remediation scheme a validation report must be prepared, which is subject to the approval in writing of the Local Planning Authority prior to the occupation of any buildings.
Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No construction or demolition work shall take place on Sundays or Public Holidays or outside the hours of 0800 to 18:00 Monday to Friday and 08:00 to 13:00 on Saturdays. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to its / their installation as part of the development hereby approved, details of the materials to be used in the construction of the external surfaces of the the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:-
- type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework;
- type, colour, texture, size and design of roofing materials - in particular the eaves detailing to surround the green roof;
- type of mortar;
- a precise specification of the proposed external render or plaster – including any decorative panels or patterns – and detailed specification of the mix, the number of coats and surface finish to be used;
- detailed specification of any timber and metal cladding, showing the dimensions, profile and a description of the stain or paint finish to be applied to the cladding;
- details of the timber framing including joint details and methods of infilling;
- external joinery details along with architectural details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings;
- details of any rooflights, including drawings showing design, materials and profile;
- details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour;
- details of external doors/garage doors including information on finish;
The development shall be carried out using the materials as approved.
Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |

The BNG measures so approved shall be maintained for at least 30 years.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and wider area, and delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The dwelling hereby approved shall be brought into use until the access, turning area and parking facilities shown on drawing number 2402-PL101 Rev E have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times.
Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway, in accordance with SWDP4 and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
REASON: In the interests of highway safety in accordance with SWDP4 and the relevant aims and objectives of the National Planning Policy Framework. |
| No dwelling hereby permitted shall be occupied until sheltered and secure cycle parking (minimum one bicycle) to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.
Reason: To comply with the Council’s parking standards as outlined within the Worcestershire Streetscape Design Guide, in accordance with SWDP4 and the relevant aims and objectives of the National Planning Policy Framework. |
| The Development hereby approved shall not commence until a detailed Construction Method Statement has been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. This shall include but not be limited to the following:
- Sequence of works and methodology for the demolition/removal of any structures supporting or abutting the public highway, including sequence of works for the demolition of basement walls;
- Details of equipment, tools and machinery to be used in any demolition works;
- Fall prevention measures;
- Details and plan of any proposed hoardings, temporary footway closures and diversions; and
- Details and plan of any equipment which may over-sail the public highway.
The measures set out in the approved Plan shall be carried out and complied with in full during the demolition of the existing structures and construction of the development hereby approved.
Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with SWDP4 and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan. |
| Prior to its installation on site, a Microgeneration Certification Scheme (MCS) accredited installer must provide confirmation in writing to the LPA that the Air Source Heat Pump (ASHP) installation will meet the requirements of the MCS Planning Standard; and the ASHP will produce a noise level of no more than 42dB LAeq (5mins) at the nearest bedroom/lounge window when operating; through source noise level data, distance attenuation and screening calculations etc. MCS compliance certification must be submitted to the LPA within 3 months of installation.
Reason: To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| Prior to the first use / occupation of the development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
- the overall predicted energy requirements of the approved development;
- the predicted energy generation from the proposed renewable/low carbon energy measures; and
- an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
| This permission does not authorise the Applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely responsible for all costs associated with construction of the access. |
| It is recommended that tree surgery operations are carried out according to the British Standard (BS) 3998 - Recommendations for Tree Work (2010). The aim of BS 3998 (2010) is to ensure, as far as is possible, that damage to the trees being worked on, to neighbouring trees or nearby property is avoided. Also, to encourage best practice when planning and carrying out tree works and to ensure that the tree works are carried out in as safe a manner as is possible. Any professional tree worker will have a good understanding of this British Standard and will ensure that their working methods are compliant with it. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:
- seeking further information following receipt of the application;
- seeking amendments to the proposed development following receipt of the application;
