Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/ drawings/ documents – Drg No. P2024_022/01C - Location Plan Drg No. P2024_022/02B - Site Plans Drg No. P2024_022/03C - Swept Path Analysis Drg No. P2024_022/04A - Vision Splay Drg No. P2024_022/06 - House 1 Plans Drg No. P2024_022/07 - House 2 Plans Drg No. P2024_022/08 - House 3 Plans Drg No. P2024_022/09 - House 4 Plans Drg No. P2024_022/10 - Carport Plans Drg No. P2024_022/11C - Water Management Statement Drg No. P2024_022/12B - Landscaping Plan Drg No. P2024_022 /14A- BIODIVERSITY GUIDE PLAN Preliminary Ecological Appraisal by worcestershire wildlife consultancy, dated 29 July 2024 Energy Statement Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Before development commences, a detailed scheme for the site access works at Abbey View Road, shall be submitted to the Local Planning Authority (and Worcestershire County Council Highways). The development shall not be occupied or brought into use until the submitted scheme, which is broadly in accordance with drawing P2024_022/02 revision B and p2024_022/04, subject to any necessary changes identified during the detailed design and Road Safety Audit processes, has been agreed in writing by the Local Planning Authority, in consultation with Worcestershire County Council Highways, and has been implemented in full. REASON: In the interests of achieving safe and suitable highway access for all users and to comply with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. REASON: In the interests of achieving safe and suitable highway access for all users and to comply with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby permitted shall be occupied until the parking spaces allocated to that property have been provided, as shown on the approved plans. Such garages and parking spaces shall be kept clear of obstruction and retained only for the parking of vehicles in connection with the use of each property as a dwellinghouse. REASON: To ensure that satisfactory provision is made for the parking of vehicles off the highway at all times and to comply with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No building hereby permitted shall be occupied until details of the design, implementation, maintenance and management of sustainable urban drainage/surface water drainage works have been submitted to and approved in writing by the local planning authority. The submitted details shall: 1. provide information about the design storm period and intensity, the method employed to delay and control the surface water discharged from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; 2. include a timetable for its implementation; and 3. provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
The recommendations (and additional recommendations) of the Preliminary Ecological Appraisal by worcestershire wildlife consultancy, dated 29 July 2024, which contains proposals to enhance the habitat on site for wildlife and biodiversity shall be implemented as set out therin in accordance with a timetable to be agreed in writing by the Local Planning Authority. The timetable shall be submitted and approved prior to the first occupation of any dwelling hereby permitted and thereafter, the enhancements secured shall thereafter be retained and/ or maintained. Reason: The proper consideration of potential impacts on protected species and biodiversity assets is a necessary initial requirement before any demolition and/or groundworks are undertaken in order to ensure that diversity is conserved and enhanced in accordance with the requirements of the NERC Act 2006 and Policy SWDP22 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking has shown on the approved plans as listed under Conditio 2 of this Decision Notice have been provided in accordance with those details. Thereafter the cycle parking shall be kept available for the parking of bicycles only. REASON: To comply with the Council’s parking standards and to comply with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the first occupancy of development hereby permitted, the renewable and/or low carbon energy generation measures as set out and detailed in the Energy Statement shall be fully implemented and operational. The measures shall thereafter be maintained and operational as approved, unless otherwise agreed in writing by the Local Planning Authority. Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
All planting and seeding/turfing comprised in the approved landscape scheme as shown on Drg No. p2024_022 / 12, Rev.B (as listed under Condition 2 of this Decision Notice) shall be carried out in the first planting season following the first occupation/use of the development OR in accordance with a timetable to be agreed in writing by the Local Planning Authority. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
Notwithstanding the provisions of article 3(1) and Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015,(or any order revoking or re-enacting that Order with or without modification), no development which would otherwise be permitted under Classes A, B, and C of Part 1 and of Schedule 2, shall be carried out. Reason: In order to protect the character and amenity of the locality, and having regard to the high design and architectural merit of the development hereby permitted and to comply with Policy SWDP1, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Whilst the details submitted are in principle, satisfactory, it should be noted that the proposed swale out falling to the receiving watercourse will require Ordinary Watercourse Land Drainage Consent. This consent must be approved prior to any works commencing on site. The consent is obtained from the Engineering Section. Attention is drawn to the response from Network Rail dated 12 November 2024, who advise an interface with them is REQUIRED for this proposal – the outside party is advised that Network Rail will need to agree and supervise this proposal & that no works are to take place until agreed with Network Rail.
