Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – [insert all approved plan numbers] - Location Plan, Drg No. 102 Proposed Site Plan (Plot 2), Drg No. 152 Proposed Elevation - Dormer Bungalow, Drg No. 352 2 Bed Dormer Bungalow – Proposed Floor Plans, Drg No. 252 E Proposed Plot Section and Elevational Materials, Drg No. 552 Landscape - Planning, Drg No. 860 02, Rev.B FINISHED LEVELS, Drg No. 6041-1001, Rev. P1 DRAINAGE STRATEGY, Drg No. 6041-1900, Rev. P4 Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Unless detailed on approved plan reference Proposed Plot Section and Elevational Materials, Drg No. 552 as listed under Condition 2 of this Decision Notice, no building operations beyond site clearance and groundworks shall commence until details of the following items have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework; - type, colour, texture, size and design of roofing materials; - sample panel of the brickwork, type of pointing and the mortar to be used with the panel - a precise specification of the proposed external render or plaster – including any decorative panels or patterns and surface finish to be used; - detailed specification of the new weatherboarding showing the dimensions, profile and a description of the stain or paint finish to be applied to the boarding; - details of the approved rooflights, including drawings showing design, materials and profile; - details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour; - details of external doors/garage doors including information on finish; The development shall be carried out using the materials as approved. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Development shall not commence (other than works associated with the implementation of visibility splays) until visibility splays are provided from a point of 1.05m above carriageway level at the centre of the access to the application site (each dwelling access) and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 43 metres in each direction measured along the nearside edge of the adjoining carriageway, to a vertical offset distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above. Reason: In the interests of highway safety and to ensure conformity with submitted details in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016 together with the aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not commence until a Construction Method Statement has been submitted to and approved in writing by the local planning authority This CMS shall include but not be limited to the following: • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc); • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring; • Details of any temporary construction accesses and their reinstatement; • Measures taken to monitor and mitigate any impacts from noise, vibration and dust emissions associated with the construction process. • Details to mitigate any adverse impact on the railway line/network rail land including restricting authorised access, measures to avoid encroachment, use of appropriate temporary construction lighting and details of all scaffolding works within 10m of the railway boundary. • Details of any vibro-impact /piling/ground works prior to their use. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the Local Planning Authority. Reason: To ensure the provision of adequate on-site facilities, to protect neighbouring residential amenity and in the interests of highway safety in accordance with policies SWDP4, SWDP21 and SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not commence until drainage plans for the disposal of foul water flows have been submitted to and approved by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use. Reason: To ensure that the development is provided with a satisfactory means of foul drainage as well as to prevent or to avoid exacerbating any flooding issues and to minimise the risk of pollution in accordance with policies SWDP28, SWDP29, SWDP30 and SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not commence until details of the finished floor levels of all dwellings/buildings and access gradients have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. No dwelling shall have a ridge height that exceeds 8m. Reason: To ensure the proposal integrates with the surroundings, to minimise any wider landscape and visual impacts and in the interests of highway safety in accordance with policies SWDP4, SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until an area has been laid out within the curtilage of the dwelling for the parking of 2 cars at a gradient not exceeding 1 in 8. This area shall thereafter be retained for the purpose of parking a vehicle only. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan 2016 together with the aims and objectives of the National Planning Policy Framework.
All existing trees and hedges on site, or branches from trees on adjacent land that overhang the site, unless indicated to be removed as part of any reserved matters approval, shall be retained and shall not be felled or pruned or otherwise removed within a period of five years from the completion of the development. Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts. This protective fencing shall remain in place until the completion of development. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. If any retained tree/hedge is removed, uprooted or destroyed or dies, replacement planting shall be carried out in the first available planting season of such species, sizes and numbers and in positions on site as may be specified by the Local Planning Authority. Reason: To prevent existing trees/hedges from being damaged during construction work and to protect the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
