Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 01 Proposed Plans 01 Existing Block Plan OS Map Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
A bat box shall be installed within the land ownership of the site (e.g. Ibstock enclosed bat box, Habibat bat box, Schwegler Wall-mounted Bat Shelter 2FE, Schwegler 2F Bat Box). The box should be installed at least 4m above ground-level, and not placed above windows. The roosting feature shall be installed before the first use of any part of the development. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
The applicant must be aware of their obligations towards the public right of way as follows: - The Public safety of those using the right of way must be ensured at all times. - There must be no diminution in the width of the rights of way available for use by the public. - There must be no change to the surface of a Public Right of Way without written consent from the authority. - Building materials must not be stored on the rights of way. - Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. - No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority
Prior to the commencement of the development hereby permitted, a reasonable avoidance measures method statement shall be submitted to and approved by the Local Planning Authority. This should include details of suitable precautionary measures required to protect any potential amphibians or other wildlife present on site. The works shall thereafter be carried out in accordance with the approved reasonable avoidance measures method statement. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017.
The development hereby approved shall only be used privately, incidental to the dwellinghouse known as Pineapple Farm, and shall not be used for any non-incidental trade, business or commercial enterprise whatsoever. Reason: To ensure no harm is created to the amenity of the local area and nearby residences in accordance with policy SWDP21 of the South Worcestershire Development Plan.
