Condition Details / Information Notes
The proposed storage container, due to its stark and utilitarian appearance forms an incongruous and alien feature that would be out of keeping within the setting of the Listed Building and as such would have a visually intrusive impact. This harm can no longer be mitigated against by allowing the siting of the storage container for a temporary period of time due to the accumulation of time already allowed and the failure of the Applicant to resolve the issue of providing suitable storage facilities on the site within the permitted timeframes. The harm would be less than substantial, however in this instance the public benefit of the scheme would not outweigh the level of harm identified to the significance of heritage asset and its setting The proposal would therefor fail to conserve and enhance the setting of the heritage asset contrary to Policies SWDP6 and SWDP24 of the development plan and the provisions of the National Planning Policy Framework, in particular Section 16.
The retention of the storage container due to its siting and appearance would create an incongruous and alien feature that would be visually harmful to the amenities of the area, including the character of the surrounding verdant rural landscape contrary to the provisions of Policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan and the provisions of the National Planning Policy Framework, in particular, Section 12 of the Framework which state that the planning system should improve the character and quality of an area, In addition, the retention of the storage container would be detrimental to the occupiers of nearby properties causing loss of outlook that would harm the enjoyment of their outside amenity area contrary to Policy SWDP21 and the provisions of the National Planning Policy Framework, particularly paragraph 135 which states that proposals should create a high standard of amenity for existing and future users.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Due to the failure of the applicant to provide suitable storage facilites on site to mitigate against the harm caused by the proposal, despite the Council’s efforts, it is considered that consent can be refused for the reasons set out in the decision notice.
