Condition Details / Information Notes
In order to constitute permitted development, the building must have been in agricultural use as part of an agricultural unit either; on 20th March 2013, in the case of a building which was in use before that date but was not in use on that date, when it was last in use, or in the case of a site which was brought into use after 20th March 2013, for a period of at least 10 years before the date development under Class Q begins.
Based on the evidence provided, the Council consider that the building has not been in agricultural use either either on 20th March 2013, in the case of a building which was in use before that date but was not in use on that date, when it was last in use, or in the case of a site which was brought into use after 20th March 2013, for a period of at least 10 years before the date development under Class Q begins.
Additionally, should the applicant have been operating an agricultural business / unit from the application site, the use would have been unlawful by virtue of being in breach of condition 3 placed upon application W/09/02584/PN under which the building originally benefitted from permission.
The proposals therefore do not constitute permitted development as a result of failing to accord with the provisions of The Town and Country Planning (General Permitted Development) Order 2015 (as amended) Part 3, Class Q, Part Q .1(a).
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:

In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
