Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: P1 Rev 0 entitled ‘Location Plan’ P2A Rev A entitled ‘Existing Site Plan 1:500@A1’ P3B Rev B entitled ‘Proposed Site Plan 1:500@A1’ P4 entitled ‘Existing Residential Building Plans & Elevations @1:100’ P5 entitled ‘Existing Poultry Shed 01 Plans & Elevations @1:200’ P6 entitled ‘Existing Cow Shed 02 Plans & Elevations @1:200’ P11 Rev A entitled ‘ Existing Habitat Plan 1:500 P7: Proposed Office Building Plans & Elevations @1:100 P8: Proposed Workshop Plans & Elevations @1:200 P9 Proposed Storage Building Plans & Elevations @1:200 P10B Rev B entitled ‘Proposed Soft Landscape Layout 1:500@ A1’ Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the buildings as shown on the approved plan reference P3B Rev B entitled ‘Proposed Site Layout’ shall only be used for Class E g)iii) referring to the building ‘Proposed Workshop’, B8 storage within the building entitled Proposed Storage Building, and ancillary Class Eg)i use referring to the mobile home referred to as ‘Proposed Office/Reception’ and for no other purpose of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: In order that the Council may be satisfied about the details of proposal due to the particular character and location of this proposal and highways impacts and in order to comply with Policies SWDP1, SWDP2, and SWDP4 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework, 2024.
The Eg)iii use together with the wash down facility, hereby approved shall be limited to the following hours: Monday – Fridays 0800 - 1800 hours only Saturdays – 0800 – 1330 hours only No working on Sundays or Bank Holidays Reason: To ensure adequate amenity to nearby residential properties in accordance with Policy SWDP21 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework, 2024
The operational uses hereby approved shall relate solely to the operation of the business entitled ‘Systematic Servicing (Equipment) Ltd.’ and the information contained within the Planning Statement (Enigma Planning) and for no other purpose/s. Reason: To ensure that the proposal has been assessed based on the information submitted in regards to vehicular movements and the nature of the business and in order to comply with Policies SWDP1, SWDP2, SWDP4, SWDP21 and SWDP31 of the South Worcestershire Development Plan, 2016, and the relevant aims and objectives of the National Planning Policy Framework, 2024.
Prior to first occupation / operation of the site, visibility splays shall be provided from a point 0.6m above carriageway level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 120 metres in each direction measured along the nearside edge of the adjoining carriageway and offset a distance of 0.6m from the edge of the carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above in perpetuity. Reason: In the interests of highway safety in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 together with the objectives of the National Planning Policy Framework, 2024.
Prior to first occupation / operation of the site, the first 5m of the existing access shall be surface in a bound material and shall be kept in that condition for the lifetime of the development. Reason: To ensure that detriment does not enter on to the local highway network resulting in a highway safety issue in accordance with Policy SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
Prior to first operation / occupation of the site, the recommended noise mitigation measures detailed within the Noise Impact Assessment, Walnut Acoustics WA/112/NIA dated 27.11.2024, relating to the fabric of the workshop building and the washdown area shall be implemented. Reason: To ensure that any harms to the amenity of the nearest residential receptors by way of noise are mitigated in accordance with Policies SWDP1, SWDP21 and SWDP31 South Worcestershire Development Plan, 2016, together with the relevant aims and objectives of the National Planning Policy Framework, 2024.
Prior to first operation /occupation full details of the extent, height, construction and surface density of the recommended acoustic barrier shall be first submitted to and agreed in writing by the Local Planning Authority. In terms of any external plant /ventilation openings, if necessary, the applicant should provide noise emission data to demonstrate compliance with the recommended cumulative noise limits detailed in Table 25 of the submitted Noise Impact Assessment Walnut Acoustics WA/1124/NIA-737 dated 27.11.2024 for approval. The mitigation measures shall be constructed in accordance with those approved details and installed and be fully operational in accordance with details to be agreed in writing with the Local Planning Authority. The mitigation measures shall thereafter be maintained for the lifetime of the development hereby approved. Reason: To ensure that any harms to the amenity of the nearest residential receptors by way of noise are mitigated in accordance with Policies SWDP1, SWDP21 and SWDP31 South Worcestershire Development Plan, 2016, together with the relevant aims and objectives of the National Planning Policy Framework, 2024.
Notwithstanding the submitted Landscaping Scheme, prior to first occupation / operation, a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- i. a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. ii. a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas iii. a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. iv. a written specification outlining cultivation and other operations associated with plant and grass establishment. v. a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and to enhance biodiversity in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan, 2016 together with the objectives of the National Planning Policy Framework, 2024.
The development hereby permitted shall not be first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan, 2016 together with the objectives of the National Planning Policy Framework, 2024.
Prior to the installation details of any external lighting to be provided in association with the development shall first be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and in the interests of safeguarding the rural landscape in this part in accordance with Policy SWDP22 and SWDP 25 of the South Worcestershire Development Plan, 2016 together with the objectives of the National Planning Policy Framework, 2024.
There shall be no open storage of materials or equipment outside of the areas specifically denoted on the approved amended plan referenced P3B Rev B entitled 'Proposed Site Layout Plan', listed under Condition 2 of this Decision Notice. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the rural landscape area, to ensure safe highways access and ensure the amenities of nearby residential properties are protected in accordance with Policies SWDP4, SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 together with the relevant aims and objectives of the National Planning Policy Framework, 2024.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any order revoking or re-enacting that order), no development (as defined by Section 55 of the Town and Country Planning Act 1990) as may otherwise be permitted by virtue of the following provisions shall be undertaken at the premises: Schedule 2, Part 3, Class G of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (change of use of a use within Class E (commercial, business and service) to a mixed use for any purpose within that Class ad as up to 2 no. flats). Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (change of use from a use falling within Class E (commercial, business and service) to Class C3 use. Schedule 2, Part 3, Class T d) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (change of use from a use falling within Class E to state-funded school). Schedule 2, Part 4, Class D of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (change of use of a building and any land within its curtilage to a flexible use). Schedule 2, Part 7, Class A ( extensions etc. commercial, business or service premises) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended). Schedule 2, Part 7, Class H (erection, extension or alteration of an industrial building or a warehouse). Reason: To ensure that any future change of use, extension or expansion of the site permitted through the Town and Country Planning (General Permitted Development) (England) Order 2015 is considered fully in respect of impact on the local highway network, impact on nearest residential receptors, rural landscape, scale of the site and other pollution in accordance with Policies SWDP1, SWDP2, SWDP4, SWDP21, SWDP25 and SWDP31 of the South Worcestershire Development Plan, 2016 together with the objectives of the National Planning Policy Framework, 2024.
