| The proposals include dormer windows on the north elevation which directly face the shared boundary of the site with neighbouring property Rosedale. The rear elevation windows would be positioned around 3m from this shared boundary and would therefore not comply with Paragraph 8.3.13 of the Design Guide SPD, which seeks to ensure that privacy of neighbouring properties is protected by maintaining a minimum distance of 5 metres per storey between any new windows and adjoining shared boundaries. The scheme may therefore result in overlooking and a loss of privacy to users of the above-mentioned properties, and as such the scheme is considered to be contrary to SWDP21 (iv) and the Design Guide SPD. |
| By virtue of the size, scale and design of the proposed extension to the existing annex, the building would not complement the existing annexe and would lack subservience to the main dwelling. Further, due to the proposed design of the extension, in particular the dormer windows, as well as the level of accommodation proposed, the development would not demonstrate a clear reliance upon the host dwelling. The resulting annexe building would therefore be read as, and would be capable of being occupied as, a self-contained dwelling. The proposed development is therefore contrary to adopted South Worcestershire Development Plan (2016) Policy SWDP2 and Policy SWDP21, the South Worcestershire (2018) and the Framework. Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires the local planning authority to determine planning applications in accordance with the development plan unless there are material considerations which indicate otherwise. There are no other material considerations that justify a departure from the policy in this case. |

| In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available nor was pre-application advice sought prior to its submission. As a result the Council has been unable to seek solutions to problems arising from this application as the amendments required to make the application acceptable are substantial and are considered to materially change the development proposals. They would require further consultation to be undertaken prior to determination which could not take place within the statutory determination period specified by the Ministry of Housing, Communities & Local Government. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. |
