Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information including details on the proposed materials provided on the application form and the following plans/drawings/documents; 1. Site Location Plan reference LP01 Rev B Issue 1 submitted 3 March 2025 2. Block Plan reference PP01 Rev B Issue 1 submitted 3 March 2025 3. Proposed Details Plan (fence and gate) reference DP01 Issue 1 submitted 11 December 2024 4. Lighting Block Plan reference PP01 Rev A Issue 1 submitted 17 Sept 2025 5. Proposed Lighting Elevations Plan reference DP02 Rev 01 submitted 17 September 2025 4. Menage External Lighting R1 Specifications Calculations submitted 17 September 2025 Reason: To define the permission in accordance with Policy SWDP 1, SWDP 2, SWDP 22, and SWDP 25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development to mitigate flood risk and deal with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall only be used for private use incidental to the dwellinghouse known as Jaspers Farm, and shall not be used for any trade, business or commercial enterprise whatsoever. Reason: On the basis of how the application has been submitted and assessed; to ensure the local road network can accommodate the type and volume of traffic generated from the development safely without undue environmental consequences; and in the interests of the amenity of the local area and nearby residences, and to ensure a sustainable pattern of land use in accordance with policies SWDP1, SWDP4, and SWDP 21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved and land edged red and blue on the approved plans as listed under Condition 2 of this Decision Notice shall not be sold, let, or sublet separately from each other Reason – In the interests of sustainable development, to avoid piecemeal and unrelated development in the countryside and to comply with Policies SWDP1, SWDP2, SWDP4, and SWDP12 and the relevant aims and objectives of the National Planning Policy Framework.
Only external lighting as shown and thereafter used in accordance with approved details listed under Condition 2 of this Decision Notice shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework (NPPF) and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The ecological protection, mitigation, compensation and working methods scheme including the Biodiversity Enhancements, as recommended in the report 'Baseline Ecological Survey Proposed Extension to Existing Menage Jaspers Farm – Grafton Flyford Worcestershire' by Liz Mckay Consultant Ecologist, dated September 2024, shall be implemented and hereafter maintained in full as stated unless otherwise approved in writing by the local planning authority. Reason: To ensure that all species are protected and habitats enhanced having regard to the Wildlife and Countryside Act 1981, Conservation of Habitats and Species Regulations (2017), National Planning Policy Framework, NERC Act (2006), and South Worcestershire Development Plan Policies SWDP5 and SWDP22.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved [Habitat Management and Monitoring Plan (HMMP)] or [Landscape and Ecological Management Plan (LEMP)]. Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule &A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan.
The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include: (a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; (b) the pre-development biodiversity value of the onsite habitat; (c) the post-development biodiversity value of the onsite habitat; Advice about how to prepare a Biodiversity Gain Plan and a template can be found at https://www.gov.uk/guidance/submit-a-biodiversity-gain-plan
The applicant must be aware of their obligations as follows with regard to Grafton Flyford Bridleway GF - 606: • The Public safety of those using the right of way must be ensured at all times. • There must be no diminution in the width of the rights of way available for use by the public. • There must be no change to the surface of a Public Right of Way without written consent from the authority. • Building materials must not be stored on the rights of way. • Vehicle movements and parking are to be arranged so as not to unreasonably interfere with the public’s use of the rights of way. • No additional barriers are to be placed across the rights of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority.
