Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans – HP011224 entitled 'Site Location Plan A1' HP021224 entitled 'Elevations A1' HP031224 entitled 'BNG Plan A1' Reason: To define the permission in accordance with Policies SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 and the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the building as indicated within the approved plan referenced HP011224 entitled ‘Site Location Plan A1’ shall only be used for Class B8 (storage) and for no other purpose of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Reason: In order that the Council may be satisfied about the details of proposal due to the particular character and location of this proposal and highways impacts in accordance with Policy SWDP1, SWDP2 and SWDP4 of the South Worcestershire Development Plan, 2016.
The B8 use hereby approved shall relate solely to the operation of the business entitled ‘R J Bespoke Interiors Ltd.’ and the information contained within the Planning Statement (Harrison Pick Ltd.) and the Transport Statement (DTA ) and for no other purpose. Reason: To ensure that the proposal has been assessed based on the information submitted in regards to vehicular movements and the nature of the business and in order to comply with Policies SWDP1, SWDP2, and SWDP4 of the South Worcestershire Development Plan, 2016 together with the relevant aims and objectives of the National Planning Policy Framework.
The uses operating from the site shall be limited to operations taking place between 07:00 and 19:00 hours Monday to Friday, with Saturday operations restricted to 08:00 to 13:00 hours. There shall be no operations in connection with the businesses occupying these buildings on Sundays or Bank Holidays. Reason: To prevent unacceptable levels of noise or disturbance that would be harmful to neighbouring residential amenity in accordance with SWDP21 of the South Worcestershire Development Plan, 2016.
The development hereby approved shall not be first used until the visibility splays approved under associated Planning Reference W/23/02570/CU shown on Drawing No. 2446-01 (Transport Statement, DTA) have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety in accordance with SWDP4 and SWDP21 of the South Worcestershire Development Plan, 2016.
There shall be no open storage of materials in connection to the business or equipment on the application site other than within those areas specifically denoted on the approved plan(s). Reason: To ensure the proposed development does not have an adverse impact on the character and appearance of the landscape in accordance with Policy SWDP2, SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016
Prior to the installation details of any external lighting to be provided in association with the development shall first be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and in the interests of safeguarding the rural landscape in this part in accordance with Policies SWDP22 and SWDP 25 of the South Worcestershire Development Plan, 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
A Public Right of Way (PROW) (Reference: NC-534) crosses near to the extent of the Application Site. The permission does not authorise the stopping up or diversion of the right of way. The right of way may be stopped up or diverted by Order under Section 257 of the Town and Country Planning Act, 1990, provided that the Order is made before the development is carried out. The Applicant is reminded that: No disturbance of, or change to, the surface of the path or part thereof should be carried out without our written consent. No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way. No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. The safety of the public using the right of way is to be ensured at all times. If public safety demands a temporary closure of the PROW, an application should be made to the The Public Rights of Way Mapping Team at countryside@worcestershire.gov.uk
