Condition Details / Information Notes
The mobile unit and all associated hardstanding/matting hereby permitted shall be removed from the site and the land restored to its condition before the development commenced within five years from the date of this permission. Reason: The mobile unit is only justified on a temporary basis to allow the Council's five year housing land supply position to change, to avoid the long term establishment of a separate unit of residential accommodation in this location, in accordance with policy SWDP1 of the South Worcestershire Development Plan 2016, and the relevant aims and objectives of the National Planning Policy Framework.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: Location Plan OS100035409, submitted 16.04.2024; Block Plan Rev A submitted 15.04.2025; Proposed Elevations 2024-26-02, submitted 16.04.2024; Proposed Floor Plan 2024-26- 01, submitted 16.04.2024. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The residential use hereby permitted shall be restricted to the stationing of no more than 1 caravan / mobile home, as defined in the Caravan Sites and Control of Development Act 1960 and the Caravan Sites Act 1968. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Within one month of the date of this permission, the parking and turning area, and the cycle parking shown on the Block Plan Rev A submitted 15.04.2025, shall be fully provided on the site and retained thereafter in that condition for the duration of the development. These areas shall not thereafter be used for any other purpose than the parking and turning of vehicles and parking of cycles. Reason: To ensure that the development incorporates and provides the required provision for the required parking facilities in the interest of highway safety and the amenity of the area, in accordance with policy SWDP21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Within one month of the date of this permission, a bird nesting box shall be installed within the site. The bird box shall be retained thereafter in perpetuity, unless otherwise approved in writing by the Local Planning Authority. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Within one month of the date of this permission, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The mobile home shall be sited in accordance with the submitted Block Plan received on 18 December 2024. Any material change to its position or its replacement by another mobile home in a different location shall only take place in accordance with details submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the proposed development does not adversely affect the character / appearance of the landscape and general environment and to protect the amenity of the neighbouring residential development, in accordance with policy SWDP21 of the South Worcestershire Development Plan 2016, and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information in relation to the proposed development following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
Public Right of Way: - The owner or occupier of the land is responsible for maintaining trees and other vegetation to prevent obstruction or danger to users of the right of way. - The planting of trees, shrubs or other vegetation must not disturb the surface of the right of way. - If Public Safety demands a temporary closure at any time, application should be made at least 6 weeks in advance to: the Public Rights of Way - Mapping Team at Worcestershire County Council prowclosures@worcestershire.gov.uk. The applicant should also take note of the Department of Environment Circular 1/09 (Defra) 2011, Part 7 emphasises that the effect of development on a public right of way is a material consideration in determining planning applications.
