Condition Details / Information Notes
The proposal is described as self-build housing; however, insufficient evidence has been provided to demonstrate that the initial occupiers of each dwelling have had a primary role in the design and layout of their respective homes. The repetition of the ‘Type A’ dwelling, which is identical to that approved under applications W/23/02540/TDC5 and W/24/01808/FUL, further indicates a lack of individual input and bespoke design. As a result, the proposal fails to meet the definition of self-build or custom housebuilding as set out in the Self-build and Custom Housebuilding Act 2015 (as amended), and is contrary to the aims and objectives of the National Planning Policy Framework (2024), which seeks to support and promote genuine self-build and custom housebuilding opportunities.
Further to Refusal Reason 1, above, the proposal is therefore not an exemption from Biodiversity Net Gain requirements (BNG) and is therefor contrary to Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021), Government Guidance ‘Understanding biodiversity net gain’ (Last updated 22 February 2024) and the relevant aims and objectives of the National Planning Policy Framework.
The proposed development would result in an unacceptable standard of amenity for third-party occupiers under application W/24/01808/FUL due to the poor outlook and overbearing impact from the ground floor office room on the side elevation, which will directly face a blank wall elevation. This close proximity would create a overbearing and oppressive living environment, with limited daylight and visual outlook. The proposal is therefore contrary to Policy SWDP 21 of the South Worcestershire Plan and the Design Guide, both of which require development to provide a high standard of amenity for future occupants. Further to this, it is contrary to paragraph 139 of the National Planning Policy Framework.

In the absence of a legal agreement to secure an affordable housing contribution, the proposal would be contrary to Policy SWDP 15 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
