| No part of development shall be commenced, including any site clearance, until a Biodiversity Gain Plan (BGP) has been submitted to and approved in writing by the Local Planning Authority. The plan shall be based on baseline assessments and habitat enhancements measured through the latest Defra metric and shall thereafter be implemented in full as approved.
Reason: To ensure compliance with Policy SWDP 22 of the South Worcestershire Development Plan and the Environment Act, 2021 and the relevant aims and objectives of the National Planning Policy Framework. |
| The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP), has been prepared in accordance with the approved Biodiversity Gain Plan, the approved landscape scheme and BNG assessments and calculations, submitted to and approved in writing by the Local Planning Authority. It shall include:
(a) a non-technical summary;
(b) the roles and responsibilities of the people or organisation(s) delivering the HMMP;
(c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan;
(d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and
(e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority,
Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the HMMP have been completed.
The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP.
Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.

| No development hereby permitted above floor slab level hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:-
- samples of external materials, including a precise specification of the colour and surface finish of the proposed external render;
- samples of roofing materials;
- details of external doors/garage doors including information on finish;
- rainwater goods
The development shall be carried out using the materials as approved.
Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to their installation as part of the development hereby approved, details of the following shall be submitted to and approved in writing by the local planning authority:-
- external window details along with the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings
- details of the approved rooflights, including drawings showing design, materials and profile;
The development shall be carried out using the materials as approved.
Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No dwelling hereby approved shall be occupied until the vehicular access, each individual dwelling’s vehicular parking, and the turning facilities have been provided as shown on the approved Drawing no. 2786-11D
Reason - In the interests of highway safety in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not be occupied until the visibility splays shown on Drawing 2786-11D have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway.

| The Development hereby approved shall not be occupied until the first 5m of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.

| Prior to the first occupation of any dwelling hereby approved secure parking for cycles to comply with the Council’s standards shall be provided within the curtilage of each dwelling and these facilities shall thereafter be retained for the parking of cycles only.

| The Development hereby approved shall not be brought into use until the highway improvements comprising the construction of a 2.0m wide footway to the east of the site access, to tie into the existing footway along the A442 Worcester Road as shown on Drawing 2786-11D, has been constructed and completed.
Reason: In the interests of sustainable development and promoting active travel in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the first occupation of the dwellings hereby permitted, details of water efficiency measures to demonstrate that the daily non-recycled water use per person will not exceed 110 litres per day shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented in accordance with he approved details.
Reason: To demonstrate effective management of water in accordance with policy SWDP 30 and the relevant aims and objectives of the National Planning Policy Framework.

| Before the development hereby permitted is first occupied, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the first occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the occupation of any part of the development hereby permitted details of the siting, design and appearance of the renewable or low carbon energy generating facilities to be incorporated as part of the development shall be submitted to and approved in writing by the local planning authority. The approved facilities shall be implemented in accordance with the approved details.
Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy 27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The development hereby permitted shall not be occupied until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the first occupation of any of the dwellings hereby approved, details of superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be submitted to and approved in writing by the local planning authority. The submitted details shall include an implementation programme. The facilities shall be provided in accordance with the approved details.
Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal and BNG Report, ref, AE0134/1/1 dated 12.12.2024 by Aware Ecology Ltd and the Bat Roost Assessment Survey, ref, AE0134/2/1 dated 21.06.25 by Aware Ecology Ltd and submitted with this application. In particular:
- x 3 bird boxes, x 2 swift bricks and x 1 house sparrow terrace.
- x 3 bat boxes on suitable features at the perimeter of the site or on the buildings themselves.
- other bat compensation measures such as ridge tiles, integrated bat boxes and bat bricks.
- insect bricks.
- hedgehog highways along any close-board fencing.
- hedgehog boxes within scrub planting area along the eastern hedgerow.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The development shall be carried out in accordance with the avoidance measures in Paragraph 4.4.1.1 of the Bat Roost Assessment Survey, ref, AE0134/2/1 dated 21.06.25 by Aware Ecology Ltd unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays, Public or Bank Holidays.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no new windows or other openings other than those expressly authorised by this permission shall be constructed in the east side elevation of Plot 1 following the completion of the development hereby permitted.
Reason: To safeguard the residential amenities of nearby properties in accordance with Policy SWDP 21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| The granting of this planning permission does not remove any obligations on the
applicant to undertake a technical design check of the proposed highway improvement
works with the Highway Authority (Worcestershire County Council, WCC), nor does it
confirm detailed design approval by the Highway Authority until the design check
process has been concluded. Upon the satisfactory completion of the technical check
the design would be suitable to allow relevant conditions imposed under this
permission to be discharged but works to the public highway cannot take place until a
legal agreement under Section 278 of the Highways Act 1980 has been entered into
to allow the works and the applicant has complied with the requirements of the New
Roads and Streetworks Act 1991 (NRSWA) and Traffic Management Act 2004. The
person or organisation shall follow the necessary procedure by applying to WCC
Streetworks Team for road space for a period to be agreed. |
| Any work involving the removal or disturbance of ground or structures supporting or
abutting the publicly maintained highway should be carried out in accordance with
details to be submitted to and approved in writing by the Highway Authority |
| This permission does not authorise the Applicant to carry out works within the publicly
maintained highway since such works can only be carried out by the County Council’s
Approved Contractor, Ringway Infrastructure Service who can be contacted by
email worcestershirevehicle.crossing@ringway.co.uk. The Applicant is solely
responsible for all costs associated with construction of the access.

| The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition “(the biodiversity gain condition”) that development may not begin unless:
(a) a Biodiversity Gain Plan has been submitted to the planning authority, and
(b) the planning authority has approved the plan.
Subject to Paragraph 14(2) of Schedule 7A TCPA 1990 The biodiversity gain plan must include:
(a) information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat;
(b) the pre-development biodiversity value of the onsite habitat;
(c) the post-development biodiversity value of the onsite habitat;

| Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway. |
