| The proposed development fails to provide a safe and suitable means of access for all users. The visibility splays required to serve the vehicular access extend onto third-party land outside the control of the applicant and the Highway Authority. As such, adequate visibility cannot be achieved in accordance with the standards set out in the Worcestershire Streetscape Design Guide. The proposals would therefore result in an unacceptable impact on highway safety, contrary to Policies SWDP4 and SWDP17(viii) of the South Worcestershire Development Plan and Paragraphs 115 and 116 of the National Planning Policy Framework. |
| The proposed development fails to comply with Policy SWDP17 of the South Worcestershire Development Plan (2016). Specifically, the proposal conflicts with criteria (i), (iii), (v), (vii) and (viii) of Part C of the policy. The site lies within open countryside, approximately 700 metres from the development boundary of Bretforton, and is not well related to any defined settlement, failing to meet the locational requirements of criterion (i). The site is also subject to areas of medium and high surface water flood risk, and the access to and from the site along Clayfield Road is also liable to surface water flooding, contrary to criterion (iii). Furthermore, the erection of the boundary wall and the introduction of mobile homes, touring caravans and a substantial day room would result in an adverse visual impact on the open rural landscape, contrary to criterion (v). The overall scale and massing of the built form, particularly the day room, is disproportionate to the level of accommodation proposed and does not respect the rural character of the locality, contrary to criterion (vii). In addition, the proposed access fails to provide adequate visibility splays within land under the applicant’s or Highway Authority’s control, resulting in an unsafe means of access and conflict with criterion (viii). Further information is also required in relation to criterion (ix) to demonstrate whether suitable on-site services are achievable, and criterion (xi) is no longer applicable. For these reasons, the proposal is considered to be contrary to Policy SWDP17 of the South Worcestershire Development Plan (2016), as well as the Planning Policy for Traveller Sites (2015) and Paragraphs 24 to 26 of the National Planning Policy Framework. |
| The introduction of a boundary wall, gates, two mobile homes, two touring caravans, and a substantial day room within an open agricultural field would result in a form of development that is visually intrusive, overly domesticated, and at odds with the prevailing rural character of the area. The proposal fails to integrate with the existing landscape character or respect the pattern of development along Clayfield Road, thereby causing harm to the visual amenity and landscape setting of the locality. The proposals are therefore contrary to Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and Paragraph 139 of the National Planning Policy Framework. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
