Condition Details / Information Notes
The proposed development by reason of its location would conflict with the aims of the South Worcestershire Development Plan and the National Planning Policy Framework and would not constitute sustainable development. This site would not be connected to the existing settlement form and as such the proposal represents unsustainable development which is inappropriate in relation to both its historic context and the open countryside, and does not deliver sustainable development that meets the wider aspirations of Wychavon District Council. Therefore, the proposal would not be sustainable in terms of location and is contrary to Policies SWDP1, SWDP2 and SWDP4, SWDP 25 of the South Worcestershire Development Plan and the relevant provisions of the National Planning Policy Framework, including Chapter 9, that require development to minimise the demand for travel and offer genuinely sustainable travel choices.
The proposal would lead to encroachment into the open countryside resulting in an inappropriate development form that does not respect the historic context and setting required to accord with both the setting of the adjacent listed buildings settings and setting of the various heritage assets in close proximity to the application site, and in regards to the Conservation Area context. Accordingly, It is concluded that the location, land use and amount of the site is not suitable for residential development contrary to Polices SWDP 6 and SWDP 24 of the South Worcestershire Development Plan, the relevant aims and objectives of the National Planning Policy Framework having particular regard to Chapter 16 – Conserving and enhancing the historic environment, and with regards to the requirements of Sections 66(1) and 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990.
Refused Plans as Listed: Location Plan
In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
