Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Plan MAB1 Extension. Alterations Plan MAB3 Extension. Alterations (received 24/03/2025) Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Before the first occupation of the development hereby permitted, the privacy screen to the side elevation of the balcony (as shown on drawing MAB 3 received on 24/03/2025) shall be installed and shall be permanently retained in that condition thereafter. Reason - To protect the amenities of adjoining properties from unacceptable overlooking/loss of privacy and to represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The proposed development is situated within 250m of a registered landfill or significant area of unknown filled ground which potentially could produce landfill gas. The applicant is advised to consider incorporating matching landfill gas protection measures within the foundations of the proposed extension(s), so as not to compromise any existing gas protection measures which may have been installed in the existing building. If the existing building has no protection measures currently there is no need to install gas protection measures within the proposed extension.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Specialist Bat Assessment - Emergence Survey Works report carried out by CRC Ecology Ltd dated 30/11/2024 and submitted with this application. In particular: - Provision of nesting / roosting habitat Lighting during the construction and on completion should be kept to a minimum and directed away from the southern and northern boundary Pre-commencement checks of the building should be carried out prior to works for both bats and nesting birds Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
