Condition Details / Information Notes
Policy SWDP2 states that development must be considered in accordance with the National Planning Policy Framework. Chapter 13 of the National Planning Policy Framework relates to the protection of Green Belt land and states that inappropriate development is, by definition, harmful to the Green Belt. The construction of new buildings in the Green Belt is considered inappropriate; the erection of a dwelling in this location would not fall within the exceptions given in paragraph 154 of the National Planning Policy Frameworkand the proposal is therefore considered to constitute inappropriate development in the Green Belt contrary to Policy SWDP2 of the Development Plan and the relevant aims and objectives of the National Planning Policy Framework. The development would result in substantial harm to the Green Belt and the lack of five year housing land supply would not outweigh this harm. Very special circumstances, within Paragraph 153 of the National Planning Policy Framework in this case are not considered to apply, and as such the benefits/ circumstances of the proposal are not outweighed by the significant harm to the Green Belt. The proposal is therefore contrary to Policy SWDP 2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework, in particular, section 13.
The site lies outside of any development boundary as defined by the South Worcestershire Development Plan and therefore lies in an open countryside location, where, in accordance with policy SWDP2, development will be strictly controlled and limited to exceptions set out in SWDP2C and development specifically permitted by other SWDP policies, and is subject to additional restrictions and guidance contained within the National Planning Policy Framework. The proposed development would be sited in a geographically unsustainable location with poor practical access to services and facilities. Occupants would have to travel further afield to meet day to day needs such as education, employment and health services. There is insufficient public transport available that would make it attractive and reasonable for daily use. Therefore, future residents would therefore be highly reliant on the private car to meet their day to day needs. The proposed development therefore conflicts with Policy SWDP1 (Overarching Sustainable Development Principles) and SWDP4 (Moving Around South Worcestershire) of the South Worcestershire Development Plan, together with the sustainable objectives of the National Planning Policy Framework. This identified harm would significantly and demonstrably outweigh the benefits associated with the proposed development and therefore the development does not constitute sustainable development when assessed against the National Planning Policy Framework as a whole.
Under the terms of adopted South Worcestershire Development Plan policy SWDP15, permission should only be granted if a planning contribution towards affordable housing (or, if appropriate, on site provision) is secured. However, in this case no such contribution towards/provision of affordable housing has been secured. As such the proposal would be contrary to Planning Policy SWDP15 of the South Worcestershire Development Plan (2016) and guidance in the Council's Developer Contributions SPG and Affordable Housing SPG, as well as guidance contained in the National Planning Policy Framework.
