| Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference W/25/00252/CLPU registered on 6 February 2025 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice as the matter described in the First Schedule to this Notice would not be lawful as at the 6 February 2025 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- The proposed outbuilding would contain eaves that would exceed 2.5 metres in height. As such, the proposal is contrary to criterion (f) of Class E, Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development Order (GPDO) 2015. Furthermore, on the balance of probabilities, the intended design and scale of the outbuilding is considered to fall outside of the parameters of Class E. The applicant has failed to provide sufficient evidence in relation to the proposed use of the outbuilding and whether the building is reasonably required for incidental purposes to the dwellinghouse. |
