Condition Details / Information Notes
In the absence of any submitted justification or evidence to support the application to rescind the s106 agreement, and the obligations therein, this proposal is not justified and further does not accord with Policy SWDP12 Employment in Rural Areas, of the South Worcestershire Development Plan 2016 nor the relevant aims and objectives of the National Planning Policy Framework. The proposal represents an unjustified change of use and loss of rural employment land/ buildings that would fail to meet the objectives of Policy SWDP12 of the South Worcestershire Development Plan (which seeks to protect employment in rural areas), and the relevant aims and objectives of the National Planning Policy Framework, in particular with regard to Section 6 and ‘Supporting a prosperous rural economy’.
This proposal to remove the existing employment use and create a solely residential use in this location would be contrary to the locational sustainability principles and the promotion of supporting the local rural economy as set out in Policies SWDP1, SWDP2, SWDP 4 of the adopted South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework. The site lies outside of any development boundary as defined by the South Worcestershire Development Plan and therefore lies in an open countryside location, where, in accordance with policy SWDP2, development will be strictly controlled and limited to exceptions set out in SWDP2C and development specifically permitted by other SWDP policies, and is subject to additional restrictions and guidance contained within the National Planning Policy Framework. The proposed development would be sited in a geographically unsustainable location with poor practical access to services and facilities. Future residents would therefore be highly reliant on the private car to meet their day to day needs. Therefore, the proposal would be contrary to Policies SWDP1, SWDP2 and SWDP4 of the South Worcestershire Development Plan and the provisions of the National Planning Policy Framework as a whole, and with particular regard to Chapter 9, that requires development to minimise the demand for travel and offer genuinely sustainable travel choices. Furthermore, the proposal would undermine wider Government aims and objectives including Net Zero and Carbon emission targets.
