Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission W/22/00436/FUL granted 25 January 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information provided on the application form and the following plans/drawings/documents: SPA 313 01 entitled ‘location Plan’; SPA 313 03 entitled ‘Existing Block Plan’; SPA 178 05 entitled ‘Former commercial building to be removed’; SPA 225 entitled ‘Existing Floorplans; SPA 178 07 entitled ‘Two-bedroom static home to be removed’; SPA 313 11 REV A entitled ‘Proposed Elevations’; SPA 313 15 REV A entitled ‘Proposed House Plans’; SPA 313 02 REV A entitled ‘Proposed Block Plan’; SPA 313 10 REV A entitled ‘Proposed Storage Unit Plans’; SPA 313 16 REV A entitled ‘Proposed House Elevations’; SPA 313 20 entitled ‘Masterplan’; and Tree Survey and Arboricultural Impact Assessment – prepared by Westside Forestry Ltd (dated March 2022) Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan, 2016 together with the relevant aims and objectives of the National Planning Policy Framework, 2024.
No development shall take place, or other operations, including demolition works, until the measures for construction management for the protection of trees as detailed within the approved Arboricultural Method Statement, March 2024, Westside Forestry Ltd. have been undertaken. Reason: To prevent the existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with Policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016 and the aims and objectives of the National Planning Policy Framework, 2024.
The development shall be constructed in accordance with the Desk Study Walkover Survey, March 2024 Sub Surface Midlands Ltd. If any contamination is found, a report specifying the measures to be taken, including the timescale, to remediate the site to render it suitable for the approved development shall be submitted to and approved in writing by the local planning authority. The site shall be remediated in accordance with the approved measures and timescale and a verification report shall be submitted to and approved in writing by the local planning authority. If, during the course of development, any contamination is found which has not been previously identified, work shall be suspended and additional measures for its remediation shall be submitted to and approved in writing by the local planning authority. The remediation of the site shall incorporate the approved additional measures and a verification report for all the remediation works shall be submitted to the local planning authority within 21 days of the report being completed and approved in writing by the local planning authority. Reason : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy SWDP31 of the South Worcestershire Development Plan, 2016 and the aims and objectives of the National Planning Policy Framework, 2024.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement dated 18th February 2022 shall be fully implemented and thereafter retained. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with Policy SWDP29 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
Prior to the first use/occupation of the development hereby permitted, the low carbon and renewable energy measures as set out in the approved plan reference SPA_313 11 Rev D entitled ‘Discharge of Condition 11: Renewable Energy’ and document entitled ‘Discharge of Condition 11: ‘Proposed Renewable Energy/Low Carbon Energy Generation’ shall be included into the development in accordance with the approved timetable. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with policy SWDP27 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
Prior to the occupation of development, the approved sheltered and secure cycle parking details within Drawing No. 22 entitled ‘Discharge of Condition 13’ shall be provided. The approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the standards set out within the Worcestershire County Council Streetscapes Design Guide 2022 and in accordance with Policy SWDP21 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided in accordance with the approved plans. The access, parking and turning facilities shall be retained thereafter. Reason: To ensure conformity with submitted details in regards of highway safety in accordance with Policy SWDP21 of the South Worcestershire Development Plan, 2016, Worcestershire County Council Streetscapes Design Guide, 2022 and the aims and objectives of the National Planning Policy Framework, 2024.
All planting and seeding/turfing shall be carried out in accordance with the approved landscaping scheme details set out within drawing No. 23 entitled ‘Discharge of Condition 14: Landscaping’ in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP21 and SWDP25 and the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with the sustainable objectives of the National Planning Policy Framework, 2024.
The development shall be constructed out of the following materials as shown on the approved plans: Plan reference SPA_313:20 Rev A entitled ‘ Materials’ - Loose permeable Gravel – house car parking and driveway - Grey 600mm concrete slabs – house terrace/paths - Loose permeable gravel – storage unit parking and turning Plan reference SPA_313:11 Rev C entitled ‘Discharge of Condition 5:Materials’ (Storage Unit) - Profiled metal sheeting – Colour Grey (RAL 7016) - Elevations and roof – profiled metal sheeting (RAL 7016) - Doors – metal roller shutter door - galvanised silver - Pedestrian Door – metal colour galvanised silver Plan reference SPA_313:16 Rev B entitled ‘Discharge of Conditions 5: Materials’ (Live Work Unit) - Oast Russet brick - Spanish blue slate (Abeja) - Aluminium double glazed grey - Metal face security door to match windows in grey anthracite Reason: To ensure that the development is visually satisfactory in accordance with Policy SWDP21 and SWDP25 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The development shall be carried out in accordance with the approved finished floor levels as approved in Plan reference SPA_313:20 Rev B entitled ‘Masterplan’. Reason: To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area or on the amenity of neighbouring properties in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The development shall be constructed in accordance with the approved the Construction Environmental Management Plan reference SPA-313-21. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The development shall be carried out in strict accordance with the Ecological Mitigation Enhancement Scheme, report reference EMES 24-020.2 dated 27th February 2024, Barns Ecology . On completion of the scheme, the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted and approved in writing by the local planning authority to confirm whether all of the measures have been implemented in accordance with the details approved under this condition. The approved mitigation and enhancement scheme shall then be retained on site thereafter. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with advice in the National Planning Policy Framework and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010. This is in accordance with Policy SWDP22 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The development shall be constructed in accordance with the approved lighting plan reference SPA_313 11 Rev C entitled ‘Discharge of Condition 9: Lighting’ (storage unit) detailing: - No. Apollo Jacana bat friendly lighting 2700k 350 degree tilt and 180 degree tilt - 50 degree peak beam and Plan reference SPA_313 16 Rev C entitled ‘Discharge of Condition 9; lighting’ (live work unit) with the following approved details: - 4 no. Nova Optic bat friendly lighting 2700k 350 degree tilt. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan, 2016 together with the aims and objectives of the National Planning Policy Framework, 2024.
The dwelling hereby permitted shall not be occupied until it has been fitted with an electric vehicle charging point. The charging point shall comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 as per the Worcestershire County Council Streetscape Design Guide. The electric vehicle charging point shall be retained for the lifetime of the development unless it needs to be replaced, in which case the replacement charging point(s) shall be of the same specification or a higher specification in terms of charging performance. Reason: To encourage sustainable travel and healthy communities in accordance with Policy SWDP1, SWDP21 of the South Worcestershire Development Plan, 2016 together with the sustainable objectives of the National Planning Policy Framework, 2024.
i. The work element floorspace of the live/work units hereby permitted shall be finished ready for occupation before the residential floorspace is occupied and the residential use shall not precede commencement of the business use. ii. The business floorspace of the live/work elements of the development hereby approved shall be used for Use Class B8, Use Class E(g)(i) offices, E(g)(ii) research and development or E(g)(iii) industrial processes and for no other purpose, including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. iii. The residential floorspace of the live/work units hereby permitted shall not be occupied other than by a person solely or mainly employed, or last Appeal Decision employed in the business occupying the business floorspace of the associated unit, a widow or widower of such a person, or any resident dependants. iv. The residential use of the live /work units hereby permitted shall be ancillary with the floor space split at least 60% employment and no more than 40% residential. v. The residential accommodation within each live/work unit hereby permitted shall contain no more than three bedrooms vi. The residential and work spaces shall be entirely separate. with separate entrances and toilet facilities. Reason: To ensure the development provides appropriate live/work units in accordance with Policies SWDP8 and SWDP26 of the South Worcestershire Development Plan, 2016 together with the sustainable objectives of the National Planning Policy Framework, 2024.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
