| By virtue of the siting, size and scale of the proposed outbuilding, the development would visually compete with the main dwelling and would not appear subordinate in scale to the host dwelling. As such the proposed outbuilding would not have a size and scale to reflect its ancillary function and would therefore cause harm to the character of the host dwelling and the surrounding rural area. The proposed development is contrary to the adopted South Worcestershire Development Plan (2016) Policy SWDP2 and Policy SWDP21, the South Worcestershire (2018) and the Framework. Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires the local planning authority to determine planning applications in accordance with the development plan unless there are material considerations which indicate otherwise. |

| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking amendments to the proposed development following receipt of the application; considering the imposition of conditions Furthermore, the council have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
