Reason: In the interests of clarity and to ensure the development is built in accordance with the details considered in determining the application and in order to define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.

| The development hereby permitted and as shown on the approved plans listed under Condition 2 of this Decision Notice shall be used for holiday accommodation only and for no other purpose including any other purpose within Class C of the Schedule of the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification.
Reason: Having regard to Policy SWDP1, SWDP2, SWDP6, SWDP21, SWDP25, SWDP35 and SWDP36 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework the local planning authority are not prepared to allow the introduction of permanent unrestricted residential development on the basis of how the application has been submitted and assessed, having regard to the settlement pattern and character and appearance of the conservation area hereabouts. |
| (A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and:
a) The programme and methodology of site investigation and recording.
b) The programme for post investigation assessment.
c) Provision to be made for analysis of the site investigation and recording.
d) Provision to be made for publication and dissemination of the analysis and records of the
site investigation.
e) Provision to be made for archive deposition of the analysis and records of the site
investigation.
f) Nomination of a competent person or persons/organisation to undertake the works set
out within the Written Scheme of Investigation.
(B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured.
Reason: In accordance with the requirements of paragraphs 207 and 218 of the National Planning Policy Framework (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of the development, full details of a scheme for the provision of foul drainage for the site shall be submitted to and approved in writing by the Local Planning Authority. These details shall:
• Include the design of all on and off-site foul sewerage infrastructure, the diameters of proposed pipes, the capacity of any on or off-site storage and the private pumping discharge rate;
• Include a timetable and programme for the provision of the foul sewerage infrastructure; and
• Demonstrate that, where connection to a public sewer is proposed, any additional foul sewerage discharge can be accommodated within the public sewer system without increasing the risk of flooding or backing up of the existing system on the site or elsewhere.
The development shall be carried out in accordance with the approved details and the approved timetable and programme.
At no time shall the private pumping discharge rate for the site as a whole exceed 0.87 l/s as set out in the submitted Drainage Strategy unless otherwise agreed in writing with Severn Trent Water in advance.
Reason: To ensure that the development is provided with a satisfactory means of drainage as well as reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution and to ensure compliance with Policies SWDP28, SWDP29 and SWDP30 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) as well as the relevant aims and objectives of the National Planning Policy Framework.

| No works or development shall take place until a Construction Surface Water Management Plan has been submitted to and approved in writing by the Local Planning Authority. The plan shall include how surface water will be managed during the construction phase, including site clearance, soil stripping and pond amendments. The plan shall include drawings of any temporary drainage systems, a timeline of construction and measures to mitigate the risk of pollution (including silt) of the water environment and offsite flood risk. The plan shall detail how the approved permanent surface water drainage system shall be remediated during the construction phase. The approved construction surface water management plan shall be implemented as soon as works start on site and thereafter maintained during the full duration of the construction phase.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development, a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area or its biodiversity in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Notwithstanding the submitted drainage strategy, no works or development shall take place until a scheme for a Surface Water Drainage Strategy for the proposed development has been submitted to and approved in writing by the Local Planning Authority. The strategy shall include details of surface water drainage measures, including for impermeable and permeable areas, and shall conform with the national standards for sustainable urban drainage systems (2025). If possible infiltration techniques are to be used and the plan shall include the details and results of field percolation tests. The results of a site wide topographical survey shall be provided to inform the routing of surface water flows and a drainage catchment area plan. The scheme shall provide detailed design drawings for all drainage assets and should include run off treatment proposals for surface water drainage. Exceedance flows should not be directed to accommodation. Where the scheme includes surface water drainage assets, proposals for dealing with the future maintenance of these assets should be included. The scheme should include proposals for informing future occupiers of the arrangements for maintenance of surface water drainage assets. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed scheme.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development, a Habitat Management and Monitoring Plan (the HMMP), has been prepared in accordance with the approved Biodiversity Gain Plan and the approved landscape scheme, submitted to and approved in writing by the Local Planning Authority. It shall include:
(a) a non-technical summary;
(b) the roles and responsibilities of the people or organisation(s) delivering the HMMP;
(c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan;
(d) secure appropriate maintenance, management and monitoring of the habitats on site over the 30 year BNG period.
(e) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development;
(f) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority; and
(g) measures for the long-term management of the new landscaping and existing vegetation.
(h) Details and locations of the wildlife boxes.
Notice in writing shall be given to the Council when the habitat creation and enhancement works as set out in the HMMP have been completed.
The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP.
Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.
Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development a Phasing Strategy setting out the phasing of development across the approved site shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall show that development will first utilise the available locations closest to the central community building and extend outwards towards the edges of the site as development progresses.
Reason: To ensure the proposed development comes forward in a managed and planned way which limits the impact on the character and appearance of the surrounding landscape and adjacent National Landscape or its biodiversity in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:-
• Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc);
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring.
• Details of any temporary construction accesses and their reinstatement.
• A highway condition survey, timescale for re-inspections, and details of any reinstatement.
• Detailed delivery programme for the holiday lodges.
The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the Local Planning Authority.
Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety and in accordance with Policy SWDP04 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development, a Construction and Ecological Management Plan for Biodiversity (CEMPB) shall be submitted to and agreed in writing by the Local Planning Authority. The content of the CEMPB shall be based on the recommendations contained within Ecological Appraisal & BNG Assessment dated February 2025 and the Addendum dated 10th September 2025. It shall be guided by the requirement to achieve a Biodiversity Net Gain, and the development undertaken in accordance with the approved document and shall maintain this after implementation.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development an Energy Statement shall be submitted to and approved in writing by the Local Planning Authority. The statement shall detail how the proposed scheme will incorporate facilities to enable at least 10% of predicted energy requirements to be achieved via renewable or low carbon sources or that achieving this would make the development unviable. The development shall be carried out in accordance with the approved details thereafter.
Reason: In the interests of the environment and to ensure compliance with Policy SWDP27 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development a Nuisance Management Plan detailing the proposed measures to minimise, monitor and mitigate emissions of noise and dust during the proposed development works shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved development thereafter.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area or the amenities of nearby occupiers in accordance with SWDP21, and SWDP31 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| Within one month of the commencement of the development hereby permitted, details (type and location) of bat roosting, bird nesting and invertebrate boxes and other features, such as refugia and hibernacula shall be submitted to the Local Planning Authority. The features approved shall be installed in accordance with the approved details prior to the first occupation/use of the development hereby approved and retained thereafter.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| With the exception of details required by other conditions, the details set out in the submitted Water Management Statement and Flood Risk Assessment dated July 2025 shall be fully implemented and remained thereafter, prior to the first occupation of the development hereby permitted.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby permitted shall not be first occupied until details of cycle parking, for lodges and staff, to comply with the Council’s adopted Streetscape Design Guide, have been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure residents of the development site are offered a genuine choice of sustainable travel modes and to promote sustainable access to the development site and in accordance with the NPPF and Policy SWDP04 of the South Worcestershire Development Plan and relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR).

| No building or use hereby permitted shall be first occupied or use commenced until a Waste Management Plan setting out how waste will be stored and collected has been prepared, submitted to and approved in writing by the Local Planning Authority. The measures shall thereafter be implemented in accordance with the approved waste management plan for the lifetime of the development.
Reason: To ensure appropriate waste management facilities are provided to accommodate all waste generated by the development area in accordance with policy SWDP33 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not be brought into use until a Site Travel Plan has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure visitors/residents and staff of the development site are offered a genuine choice of sustainable travel modes and to promote sustainable access to the development site and in accordance with Policy SWDP04 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework
|
| In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation.
No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with:
a) Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place.
b) Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
c) The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
d) Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site.
Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors and to accord with Policy SWDP31 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The development shall be carried out in strict accordance with the submitted lighting strategy set out on plans Proposed Lighting Plan (4999-340 P9), Proposed Lighting Plan (1 of 3 - 4999-341 P9) , Proposed Lighting Plan (2 of 3 - 4999-342 P9) and Proposed Lighting Plan (3 of 3 - 4999-343 P9).
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with its surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The approved Biodiversity Gain Plan shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP).
Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP22 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| This permission is for the development of no more than 145 lodges to be thereafter located only within the areas identified for their siting as shown on the Proposed Site Plan (Drg No. 4999-310 P9) as listed under Condition 2 of this Decision Notice.
Reason: To protect the character and appearance of the Bredon Hill National Landscape, to ensure that the scheme that is delivered accords with the details considered and to accord with Policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| The external materials used in the Lodges shall be in strict accordance with the submitted Schedule of Materials – Ref 4999 Issue P3 dated 20 February 2025.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| No lodge and its associated sub base shall exceed the dimensions shown on the Typical Lodge Details Drawing 4999_SD1 P3 dated January 2025.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| No person or group of persons shall occupy the holiday accommodation hereby permitted for more than 28 consecutive days at a time and no same person or group of persons shall occupy the accommodation for more than 156 days in any one calendar year.
The owners/operators of the site shall maintain an up-to date register of the names of all occupiers of the accommodation, their duration/ dates of stay, and of their main home address (i.e. place of residence) and shall make this information available at all reasonable times to the Local Planning Authority.
Reason: To ensure that the development hereby permitted is used for the specific use applied for, to prevent unrestricted residential development, and in the interests of ensuring a sustainable pattern of development that also does not unduly increase reliance on the private motor vehicle, in accordance with polices SWDP1, SWDP2, SWDP4, SWDP21 and SWDP35 of the South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework. |
| Unless otherwise agreed as part of the approved Landscape Strategy no trees within the red and blue lines as shown on the Proposed Site Plan shall be felled without the prior written permission of the Local Planning Authority.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area or its biodiversity in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan, relevant emerging policies of the South Worcestershire Development Plan Review (SWDPR) and the relevant aims and objectives of the National Planning Policy Framework.

| LLFA
Please note that any proposals to alter existing, or construct new, culverts or carry out works in or on an ordinary watercourse will need Land Drainage Consent under s.23; Land Drainage Act 1991 from SWLDP. Such consent will need to be granted prior to works commencing on site as consent cannot be granted retrospectively. Failure to comply may result in enforcement action being taken by the Lead Local Flood Authority, Worcestershire County Council, under the Act. SWLDP may also exercise powers to require works for maintaining flow of a watercourse where appropriate under s.25 of the Act where the proper flow of water is impeded.
The applicant should be aware that polluting the nearby watercourse, for instance by allowing the discharge of sediment rich runoff from the construction site, might constitute an environmental offence. The applicant is expected to fully assess the risks from all pollution sources and pathways and take sufficient precautionary measures to mitigate these risks for this development.
