Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents; 1. Preliminary Ecological Appraisal Report by Countryside Consultants Ltd dated 27 January 2025 Reason: To define the permission in accordance with Policy SWDP 1, SWDP 2, and SWDP 36 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Holiday Let Accommodation as shown on the approved plans listed under Condition 2 of this Decision Notice shall not be sold separately from the dwellinghouse known as Christmas Cottage. Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides holiday let accommodation in accordance with Policies SWDP 36 of the South Worcestershire Development Plan, and to prevent unjustified unsustainable residential development in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3, SWDP8, SWDP12, SWDP19, and the relevant aims and objectives of the National Planning Policy Framework.
The Holiday Let Accommodation hereby approved shall be occupied for holiday purposes only and shall not be occupied as a person or persons’ sole, or main place of residence. Reason: The proposed cabin accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed accommodation is only acceptable as a holiday let/ tourism development in accordance with details submitted to define the permission, and in accordance with policy SWDP 36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP2 and SWDP36 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The operators of the Holiday Let Accommodation hereby approved shall maintain an up-to-date register of the names of all occupiers of the log cabin. This register shall be made available within 1 calendar month of a written request by the Local Planning Authority. Reason: The proposed log cabin accommodation would be situated in the open countryside, outside any defined settlement boundary where new residential development will be strictly controlled. The proposed accommodation is only acceptable as a holiday let development in accordance with policy SWDP 36 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policy SWDP 2 and SWDP 36 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The proposed landscaping and orchard planting proposed along the existing vegetation along the eastern site boundary, as shown on the submitted site block plan, shall be implemented in the first planting season and retained thereafter, for as long as the log cabin and sauna are sited on this land. Additional hedgerow planting to screen the northern site boundary between the site and Twin Oaks Caravan & Camping site on the adjacent land shall be implemented in the first planting season and retained thereafter, for as long as the log cabin and sauna are sited on this land. The proposed new habitats and planting as identified within the submitted Preliminary Ecological Appraisal Report shall be implemented in the first planting season and retained thereafter, for as long as the log cabin and sauna are sited on this land. These include; (i) creation of a 35m2 wildlife pond - excavated and lined with Bentotex synthetic clay liner and planted with native aquatic and marginals; (ii) the spoil from this excavated pond will be used to form a horseshoe shaped shallow mound to provide a hibernacula for amphibians with brick rubble core to provide hibernation opportunities; (iii) an area of 1013m2 of existing grassland will be oversown with Emorsgate EM5 wildflower mix and maintained through annual mowing; (iv) this 1013 m2 wildflower area will be planted with semi-vigorous traditional orchard fruit varieties at 8m spacing and maintained as a traditional orchard habitat; (v) residual areas of existing bare ground will be sown and established with a EM5 wildflower mix. (vi) enhancement of 88m of existing hedgerow and planting up of 40m new native hedgerow. (vii) 2 x hedgehog hibernation boxes (viii) 2 x bird boxes attached to new structures. Reason: To define the permission in accordance with submitted details, and to create an enhanced landscape buffer and provide visual screening of the approved development, and habitat creation in accordance with Policy SWDP 36 and SWDP 25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to commencement a Great Crested Newt Mitigation (and Working Method) Statement, including scope of works and rationale as to whether a European Protected Species Mitigation Licence will be applied for, will be submitted to and agreed with the local authority. Mitigation measures to be approved by the local authority could include (not exhaustive list of measures); (i) lifting the proposed log cabin and sauna off the ground using concrete piers and jacks (details of which to be approved); (ii) avoiding the need for hard surfacing for pedestrian access (such as bark chip mulch) laid directly onto the grassland; (iii) timing of key operations; (iv) manipulation of vegetation prior to ground disturbance so as to dissuade newts from being present; (v) Ecological Watching Brief to be implemented during construction by a suitably qualified and competent Ecologist Reason: Concrete pier foundations and raise lodge floor above ground level to decrease the proposed development area impacted to less than 100m2, would be in accordance with the specified figure at which Natural England consider development impacts to be non significant to great crested newt populations. These mitigation measures and others which may be agreed are cumulatively required in accordance with the submitted Preliminary Ecological Appraisal and the derogation tests and duties placed on local planning authorities by the Conservation of Habitats and Species Regulations 2010.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby permitted shall not be brought into use until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards and the relevant aims and objectives of the South Worcestershire Development Plan and National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The proposed means of surface water disposal will be via soakaways. Hard standing areas will be surfaced with permeable materials. Whilst this is, in principle, satisfactory, if ground conditions are not suitable for soakaways, then an alternative sustainable solution will be required. Additionally, the applicant must note that a soakaway must be built 5 meters away from any building, and 2.5 meters away from a boundary line.
