| By virtue of the scale and massing of the proposed development, it would result in a cumulative negative impact of extensions and a loss of visual symmetry to the application dwelling and would therefore detract from its original character. Furthermore, the prominent siting of this dwelling within the street scene and the proximity to Grade I Listed Hertiage Assets and the Evesham Conservation Area would mean that the development appears unduly dominant, causing harm to the character of the area and the designated heritage assets. There is considered to be less than substantial harm to the setting of The Evesham Conservation Area as well as the setting of nearby Listed Buildings. No public benefits have been identified that would outweigh the harm. The proposal would therefore conflict with Policy SWDP 21, SWDP 6 and SWDP 24 of the South Worcestershire Development Plan and the principles of the South Worcestershire Design Guide SPD 2018. |
| In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Unfortunately the submitted application is not considered to accord with the advice available nor was pre-application advice sought prior to its submission. As a result the Council has been unable to seek solutions to problems arising from this application as the amendments required to make the application acceptable are substantial and are considered to materially change the development proposals. They would require further consultation to be undertaken prior to determination which could not take place within the statutory determination period specified by the Ministry of Housing, Communities & Local Government. Despite the Council’s efforts, it is considered that the current planning application should be refused for the reasons set out in the decision notice. The applicant is encouraged to seek pre-application advice prior to the submission of any further formal planning application. |

| By virtue of the scale and positioning of the proposed side extensions, the development would cause a loss of light and outlook to a ground floor kitchen window at 2 Abbey Gardens. The proposal would therefore result in unacceptable adverse impacts to the living condition of 2 Abbey Gardens. The proposal is therefore contrary to Policy SWDP21 of the South Worcestershire Development Plan and the principles of the South Worcestershire Design Guide SPD 2018. |
