The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation for an Archaeological evaluation at Willow Court Farmhouse, Droitwich, Worcestershire”, prepared by Worcestershire County Council, dated 19 March 2024 and formally discharged on the 19 August 2024 pursuant to decision reference W/24/00653/CCO to comply with Condition 3 of planning permission W/23/01546/FUL and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 194 and 205 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified, it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation. No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed in writing by the Local Planning Authority, until requirements 1 to 4 below have been complied with: 1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place. 2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation. 3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. 4. Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site. Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policies SWDP21 and SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the commencement of any Phase 2 roof works, details (numbers, type and location,) of bat roosting and bird nesting features as well as refugia / hibernacula for herpetofauna, and including the five small integrated bat access opportunities, (two ridge access points and three bat tiles as described in para 4.2 of the Bat Mitigation Briefing Note by CSA Environmental dated July 2023), and the retention of six boxes on trees, (already provided), shall be first submitted to and agreed in writing by the local planning authority. The approved features shall be installed in accordance with the approved details prior to the first occupation/use of the development hereby approved and retained thereafter. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the access arrangements shown in general accordance with Drawing 7272 30D “Proposed site plan” has been provided. This access shall thereafter be retained and kept available for their respective approved uses at all times. REASON: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall be carried out in full accordance with the measures as set out in the Phase 2 Construction Transport Environmental Management Plan and formally discharged on the 19 August 2024 pursuant to decision reference W/24/00653/CCO to comply with Condition 7 of planning permission W/23/01546/FUL and shall remain in full during the construction of the development hereby approved. Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the first use/occupation of the development hereby permitted a schedule of landscape maintenance for perpetuity has been submitted to and approved in writing by the local planning authority. The schedule shall include details of the arrangements for its implementation, long-term design objectives, management responsibilities and maintenance schedules for all landscape areas (excluding domestic gardens), including the recommendations made in section 4.3 of the supporting document entitled Habitat Restoration, Enhancement and Protection) by Bearwood Ecology. The approved landscape maintenance schedule shall be fully implemented. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
As part of the development hereby approved a scheme of landscaping shall be implemented in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner in accordance with the approved details as specified on drawing no.21-078-P-05 Rev.A (Titled Planting Plan) and formally discharged on the 19 August 2024 pursuant to decision reference W/24/00653/CCO to comply with Condition 9 of planning permission W/23/01546/FUL and shall remain in full during the construction of the development hereby approved. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21, SWDP 22 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Full details of any soil or soil forming materials brought on to the site for use in garden areas, soft landscaping, filling and level raising must be provided. Where the donor site is unknown or is brownfield the material must be tested for contamination and suitability for use on site. Full donor site details, proposals for contamination testing including testing schedules, sampling frequencies and allowable contaminant concentrations (as determined by appropriate risk assessment) must be submitted to and approved in writing by the Local Planning Authority prior to import on to the site. The approved testing must then be carried out and validatory evidence (such as laboratory certificates) submitted to and approved in writing by the Local Planning Authority prior to any soil or soil forming materials being brought on to site. Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No construction works of any type should take place in the vicinity of the root protection areas of the trees identified as Tree 08 and Tree 09 in the submitted BS5837:2012 arboricultural impact assessment carried out by Bearwood Associates Ltd dated June 2025, until an arboricultural method statement and tree protection plan has been submitted and approved in writing by the local planning authority. The development shall be carried out in accordance with the approved details and all tree protection measures shall be retained until the first occupation of the building or completion of construction works whichever is the sooner. Reason: In order to ensure protection of trees on site in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Temporary fencing for the protection of all other remaining trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) and the protective fencing shall remain in place until the completion of development. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
As part of the development hereby approved all replacement trees shall be planted within 12 months of removal of the existing tree in accordance with the approved details as specified on Drawing no.21-078-P-05 Rev.A (Titled Planting Plan) and the Arboricultural Monitoring Report prepared by Bearwood Associates Ltd (dated 02 August 2024) and formally discharged on the 19 August 2024 pursuant to decision reference W/24/00653/CCO to comply with Condition 13 of planning permission W/23/01546/FUL. If within a period of five years from the date of planting, the trees (or any other trees planted in replacement for them are removed, uprooted or destroyed or dies, another tree/other trees of the same size and species shall be planted at the same place. Reason: To ensure a satisfactory replacement of the tree(s) to be removed in accordance with Policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
No dwelling hereby permitted shall be occupied until the sheltered and secure cycle parking has been provided in accordance with the details as specified on the approved plan 7272 205 rev C - Cycle and Bin Store and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the vehicular parking and turning facilities shown on drawing 7272 30D - Proposed Site Plan, been provided. These facilities shall thereafter be retained and kept available for their approved use at all times. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety in accordance with Policies SWDP4 and SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the Applicant has submitted to and had approval in writing from the Local Planning Authority a residential Travel Welcome Pack promoting sustainable forms of access to the development. The pack shall be provided to each resident at the point of occupation. Reason: To reduce vehicle movements and promote sustainable access in accordance with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out in accordance with the recommendations and mitigation measures detailed in the Flood Risk and Drainage Assessment carried out by Barnsley Marshall Ltd and submitted with this application. Reason - In the interests of the safety of future residents in accordance with Policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Alteration of Highway to Provide New or Amended Vehicle Crossover This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access. Construction Environmental Management Plan (CEMP) It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but particular reference is made to "respecting the community" this says: Constructors should give utmost consideration to their impact on neighbours and the public: • Informing, respecting and showing courtesy to those affected by the work; • Minimising the impact of deliveries, parking and work on the public highway; • Contributing to and supporting the local community and economy; and • Working to create a positive and enduring impression and promoting the Code. The CEMP should clearly identify how the principal contractor will engage with the local community; this should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues. Contractors should ensure that courtesy boards are provided, and information shared with the local community relating to the timing of operations and contact details for a site coordinator in the event of any difficulties. This does not offer any relief to obligations under existing Legislation.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; * - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
