Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Original plans: Enigma Planning Design drawing numbers P1A Rev A; Amended plans (received 21 July 2025): Enigma Planning Design drawing numbers P4 Rev B; P5 Rev A; Amended plans (received 7 August 2025): Fusionhot Proposed Plan - Revised rear elevation plan; Proposed Plan - Revised side elevation/ floor plan Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The ventilation system hereby approved shall be carried out and maintained in accordance with the Ventilation Strategy by FusionHot Ltd received on 14 August 2025, unless agreed otherwise in writing with the Local Planning Authority in consultation with Worcestershire Regulatory Services. Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable odour/noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.
The development hereby permitted shall not be open to customers outside the following hours of 0800 to 2100 Monday to Thursday, 0800 to 2300 on Friday/Saturday and 0800 to 2100 on Sundays/Bank Holidays. Deliveries to, and collections from, the development shall not be made outside these hours. Reason:- To ensure the proposal preserves residential amenity and to prevent unacceptable noise pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00 Monday to Friday and 08.00 and 13.00 on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason - To preserve the amenities of the locality in accordance with Policy SWDP21 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
