Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 1. UPS Battery Kiosk Location and Eleveations Plan A7W14015 - STA - XX - 22 - DR - T - 0007 P02 submitted 27 March 2025 Reason: To define the permission in accordance with the details submitted and the aims and objectives of the South Worcestershire Development Plan and the National Planning Policy Framework.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 07.30 and 19.00hrs Monday to Saturday including Bank Holidays. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays. Reason - To preserve the amenities of the locality in accord with the aims and objectives of the SWDP in particular Policy SWDP21 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not commence until a Construction Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority, in consultation with the Local Highway Authority. This shall include, but not be limited to, the following:- • Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. • Details of site operative parking areas, material storage areas and the location of site operatives’ facilities (offices, toilets etc). • The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring. • Details of any temporary construction accesses and their reinstatement. • Estimates of number of construction vehicles and their type, particularly HGVs and any abnormal load vehicles. The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the Local Planning Authority. REASON: To ensure the provision of adequate on-site facilities and in the interests of highway safety, and to comply with policies SWDP4 and SWDP31 and the relevant aims and objectives of the National Planning Policy Framework.
To secure a safe and effective method of removal and management of the Invasive Species: Cotoneaster from the site: 1) No development shall take place (including ground works and vegetation clearance) until an Invasive Species Strategy for Cotoneaster is submitted to and approved in writing by the local planning authority. The strategy shall include the following: - Measures taken to safely and entirely remove all present Cotoneaster during the vegetation clearance stage; - Suitable timing of the removal process (i.e. in periods where the berries are not ripe); - Measures taken to limit or prevent the re-colonisation and domination of the site by Cotoneaster; - Suggested suitable methods of disposal of all removed cotoneaster. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with South Worcestershire Development Plan policies SWDP 22 and SWDPR27, the relevant aims and objectives of the National Planning Policy Framework, having particular regard to paragraphs, 180 and 186, and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended).
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the updated Preliminary Ecological Appraisal report carried out by Ramm Sanderson Ecology, dated 27th June 2024, and submitted with this application. In particular: - The inclusion of mammal ladders or earth ramps in any open excavations at the end of each working day; - The capping off of any open pipes at the end of each working day; - Keeping all fuel and other harmful substances in a locked area; - Ensuring any spillages are treated with spill kits; - Avoiding night work, where possible, with any necessary flood lighting facing away from site boundaries; - If any evidence of badger is discovered, the notifying of an ecologist immediately and installation of a 20m buffer zone until an assessment can be made; - All vegetation clearance and tree pruning should be conducted outside of nesting bird season (March to August, inclusive); - If this is not possible, a nesting bird check should be undertaken by a qualified ecologist up to 24 hours prior to the commencement of works; - If an active bird nest is discovered, no works can proceed until all chicks have fledged; - Vegetation clearance should take place when reptiles are still active (September to early November, inclusive); - Vegetation to be cleared should be cut to a height of 15-20cm by a hand tool before proceeding further, progressing at a walking pace only; - The area should be left for 24-48 hours and then cut to 5cm using the same method and in the same direction as the first cut; - If a reptile is discovered during the works, they should be allowed to escape unharmed and at their own pace; - If multiple reptiles are encountered, all works should cease and methodology should be re-evaluated. Details of the type and location of the chosen bat and/or bird boxes shall be submitted to and approved, in writing, by the Local Planning Authority, prior to the commencement of the development. The approved boxes shall be installed prior to the development hereby permitted first being used. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with Policy SWDP5 and SWDP22 of the South Worcestershire Development Plan, the relevant aims and objectives of the National Planning Policy Framework, and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010.
Prior to the commencement of the development, hereby approved, a Landscape and Ecological Management Plan (LEMP) shall be submitted to and agreed in writing by the Local Planning authority. The content of the LEMP shall be based on the recommendations made in the approved Landscaping Scheme, and informed by a Biodiversity Net Gain Assessment and associated metric calculations, and shall maintain this after implementation. It shall include the following: a) Description and evaluation of features to be managed; b) Ecological trends and constraints on site that might influence management; c) Aims and objectives of management; d) Appropriate management options for achieving aims and objectives; e) Prescriptions for management actions; f) Preparations of a work schedule, including an annual work plan capable of being rolled forward over a five-year period and for a minimum of 30 years thereafter; g) Details of the body or organisation responsible for implementation of the plan; h) On-going monitoring and remedial measures. The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The LEMP will be implemented in accordance with the approved details. Reason To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016.
The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the plan and maintained thereafter in accordance with the approved Landscape and Ecological Management Plan (LEMP). Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990, Policy SWDP22 of the South Worcestershire Development Plan, and the relevant aims and objectives of the National Planning Policy Framework.
BNG Informative The effect of paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the Biodiversity Gain Condition”) that development may not begin unless: a) A Biodiversity Gain Plan has been submitted to the planning authority, and; b) The planning authority has approved the plan. Subject to Paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the Biodiversity Gain Plan must include: a) Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the onsite habitat and any other habitat; b) The pre-development biodiversity value of the onsite habitat; c) The post-development biodiversity value of the onsite habitat.
