Condition Details / Information Notes
The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission [insert app number and date of the permission]. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 727-21A Location Plan 727-23D Site Plan 727-24 B Live-Work Unit Plans-All Plots 727 25C Live-Work Unit Elevations-All Plots 727-26B Garage Plots & Elevations-All Plots P/20/346/003 Highway Details P/20/346/004 Highway Details Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The development herby approved shall be carried out in accordance with the details provided in the Archaeological Evaluation at Greenacres by Worcestershire Archaeology- November 2023. Reason: In accordance with the requirements of paragraphs 189 and 199 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development herby permitted shall be in strict accordance with Phase 1 Desk Study & Risk Assessment by Oracle Environment al Experts. In accordance with Part 7, in the event that contamination is found at any time when carrying out the approved development that was not previously identified in the report approved under Part 3, construction works shall cease and this shall be reported immediately in writing to the Local Planning Authority. In such circumstances an investigation and risk assessment must be undertaken and a revised remediation scheme must be produced, submitted to and approved in writing by the Local Planning Authority. Development works shall not resume until the revised remediation scheme has been approved in writing. The measures as set out in the revised remediation scheme shall be carried out. Following the completion of any measures identified in the approved revised remediation scheme a validation report must be produced, submitted to and approved in writing by the Local Planning Authority. None of the development hereby approved shall be occupied/first used until the validation report has been approved. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with policy SWDP31 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall be carried out in strict accordance with the Construction Environmental Management Plan by Addison Rees Planning Consultancy ltd. Reason: To ensure the provision of adequate on-site facilities, to minimise disturbance to neighbours and in the interests of highway safety and in accordance with Policy SWDP 4 , SWDP 21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development herby approved shall be carried out in strict accordance with the Reptile Translocation Report and Ecological Enhancement Strategy, both by Dr Stefan Bodnar and L001d Proposed Landscape Plan( dated 31st January 2024). The works shall thereafter be carried out in accordance with the approved details and timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
(1) The work element floorspace of the live/work units hereby permitted shall be finished ready for occupation before the residential floorspace is occupied and the residential use shall not precede commencement of the business use. (2) The business floorspace of the live/work unit shall not be used for the sale of goods to visiting members of the public and shall not be used for any purpose which if assessed in its own right would fall outside of Use Class E.(g) as defined under the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. (3) The residential floorspace of the live/work unit shall not be occupied other than by a person solely or mainly employed, or last employed in the business occupying the business floorspace of the associated unit, a widow or widower of such a person, or any resident dependants. Reason: To ensure the approved development complies with policy SWDP8 part G of the South Worcestershire Development Plan 2016 and to help ensure the right land and building is available for jobs and the relevant aims and objectives of the National Planning Policy Framework.
The development herby approved shall be carried out in strict accordance with the Proposed Building Materials-PBM001 (dated the 22nd August 2023). The development shall be carried out using the materials as approved. Reason - To ensure that the new materials are in keeping with the surroundings and to represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development herby approved shall be carried out in strict accordance with the Proposed Landscaping Plan- L001b (dated the 23rd November 2023). All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development herby approved shall be carried out in strict accordance with the Proposed Landscaping Plan L001b (dated 23rd November 2023), Proposed Fencing Materials PFM001 (dated 22nd August 2023) and Proposed Building Materials PBM001 (dated 22nd August 2023). The hard landscaping shall be carried out in accordance with the approved details and completed before the first occupation of the development hereby permitted. Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the progression of any further construction works associated with the development hereby permitted, beyond the works to the access which have already occurred, temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction). Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development herby approved shall be carried out in strict accordance with the Energy Statement (ref: GA4/L1a 07/23) by Avondale Solutions. Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the local planning authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement by Addison Rees dated June 2020 shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The live/work units hereby permitted shall not be occupied until superfast broadband facilities have been provided. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The Development hereby approved shall not be occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety and in accordance with Policy SWDP 4 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
No works which form part of the development hereby approved, other than the provision of the site access, shall be carried out unless and until the visibility splays shown on the approved drawing P-20-346-004 associated with planning permission 20/01058/FUL. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason: In the interests of highway safety and for the avoidance of doubt and clarity and in accordance with Policy SWDP 4 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall not be occupied until sheltered, secure and accessible cycle parking to comply with the Council's adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the local planning authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only. Reason: To comply with the Council’s parking standards and in the interest of sustainability and in accordance with Policy SWDP 4 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
The development hereby approved shall not be brought into use until the access, turning area and parking facilities shown on drawing 727-23D have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway and in accordance with Policy SWDP 4 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Appropriate cabling and an outside electrical socket shall be provided to each property to enable ease of installation of an electric vehicle charging point (houses with dedicated parking). The charging point must comply with BS7671. The socket must comply with BS1363, and must be provided with a locking weatherproof cover if located externally to the building. The charging point must comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851. As a minimum, charge points must comply with Worcestershire County Council Design Guide which requires 7kw charging points for residential developments. Reason: In accordance with Paragraph 112 and 117 of the NPPF and the relevant aims and objectives.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information and amendments, demonstrating a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
