Any Reserved Matters shall be in accordance with the submitted Parameters Plan reference 17-068 P001. The development shall be carried out in accordance with approved reserved matter details. Reason: To enable to the Local Planning Authority to exercise proper control over these aspects of the development pursuant to Section 92 of the Town and Country Planning Act 1990 (as amended).
Details of the levels of the existing site and the precise floor slab levels of the proposed buildings, relative to the existing development on the boundary of the site, shall accord with those approved through planning reference: 21/01899/RM (Wychavon District Council). Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Details of boundary treatments and surface treatments on the external areas of the site shall accord with those approved through planning reference: 21/01899/RM (Wychavon District Council). The details shall be maintained in accordance with the approved details unless otherwise approved in writing. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The landscaping shall be provided and maintained in accordance with the details approved through planning reference: 21/01899/RM (Wychavon District Council). The landscaping shall be managed in accordance with condition 2 listed on the corresponding decision notice of the listed reserved matters application. Reason: To preserve and enhance the visual amenities of the area and to ensure the satisfactory development of the site, in accordance with policies SWDP21, SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
In so far as the plans relate to the materials used in the construction of the external surfaces of the buildings hereby permitted, the details shall accord with the details listed on the following plans: - 6685 - 005 C Elevations - Unit 1; - 6685 - 006 C Elevations - Unit 2; - 6685 - 007 C Elevations - Unit 3; - 6685 - 008 C Elevations - Unit 4. Reason: To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information provided on the application form and the following plans/drawings/documents: 17-068 A002 Location Plan; 17-068 P001 Proposed Parameters Plan. Reason: To define the permission and to ensure that the development meets the design quality and environmental requirements of policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out, and the drainage maintained/managed, in accordance with the following approved details: • Sustainable Drainage Technical Note Rev 1 dated June 2021; • Drainage Strategy dwg no. 100 P3. Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
In the event that contamination is found at any time when carrying out the approved development that was not previously identified, construction works shall cease and this shall be reported immediately in writing to the Local Planning Authority. In such circumstances an investigation and risk assessment must be undertaken and a revised remediation scheme must be produced, submitted to and approved in writing by the Local Planning Authority. Development works shall not resume until the revised remediation scheme has been approved in writing. The measures as set out in the revised remediation scheme shall be carried out. Following the completion of any measures identified in the approved revised remediation scheme a validation report must be produced, submitted to and approved in writing by the Local Planning Authority. None of the development hereby approved shall be occupied/first used until the validation report has been approved. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The landscaping scheme and its subsequent maintenance schedule shall be fully implemented in accordance with the following details, unless otherwise approved in writing by the Local Planning Authority: • Soft Landscape Works Maintenance and Management Proposals – 10 Years prepared by Barry Chinn Associated Limited (ref 2051-20-RP01 dated 24/5/21) Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) for the duration of all construction activities. Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority, prior to any works occurring within an affected root protection area. This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels be altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan along with the relevant aims and objectives of the National Planning Policy Framework.
The development hereby permitted shall accord with the Written Scheme of Investigation for Historic Building Recording – HER Reference WSM73835 prepared by Ecus Ltd, dated April 2021. Within three months of the date of this permission, the site investigation and post investigation assessment shall be completed in accordance with the programme set out in the Written Scheme of Investigation and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: To protect, conserve and enhance the significance of heritage assets in accordance with policy SWDP 6 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
All external lighting shall be installed in accordance with the specifications and locations set out in the approved documents listed as follows: • Lighting details set out in letter from Harris Lamb reference PE0116/HS dated 28th June 2021; • further information in email dated 21 October 2021. The lighting shall be maintained thereafter in accordance with the approved strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010 and minimise impacts on with protected species in accordance with Policy SWDP22 and to ensure that the development does not have an adverse impact on the character and appearance of the area in accordance with Policies SWDP21 and SWDP 25 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to occupation of units 3 and 4 hereby approved, the measures to ensure that at least 10% of the predicted energy requirements of the development is met through the use of renewable/low carbon energy generating facilities set out within the following document, shall be fully implemented (and installed where appropriate) for each unit: • Energy Statement (Compliance with Approved Document Part L2A and SWDP 27 – ESC) prepared by Engineering Services Consultancy Ltd, document reference: 1601/ESC/00/ZZ/RP/Z/0005 dated 19/05/2021. The measures set out within the energy statement, including those already installed on units 1 and 2, shall be retained thereafter unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy 27 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework.
Positive and Proactive Statement: In dealing with this application, the Council has worked with the applicant by seeking further information following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
No more than two units shall be used for any B1 (office) use for more than 20% of its total floor area and no other unit contained within the site shall be used for any B1 (office) use for more than 5% of its total floor area without the prior approval of the Local Planning Authority in writing, either through a reserved matters application or discharge of condition application. Reason: In the interests of highway safety, to ensure the free flow of traffic using the adjoining highway and to ensure a sufficient level of onsite parking, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended), the units hereby approved shall be used for purposes falling within use classes B2, B8 and E(g)(iii), together with any ancillary office use falling within E(g)(i) and E(g)(ii), and for no other purpose, including any other purposes in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification. Furthermore, and notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended), other than those approved through later reserved matters applications, no mezzanine floors shall be added to the units hereby approved without prior written approval of the Local Planning Authority. Reason: To ensure appropriate definition and control of the development hereby permitted for clarity and the avoidance of doubt, to ensure the development provides appropriate employment uses and to ensure highway safety and sufficient parking provision, in accordance with Policies SWDP2, SWDP3, SWDP14 and SWDP21 of the South Worcestershire Development Plan. This will also deliver appropriate economic development, choice and opportunity in Wychavon district’s rural areas, and to prevent incompatible or harmful land use and activity in the countryside contrary to South Worcestershire Development Plan policies SWDP1, SWDP2, SWDP3 and SWDP8 and the relevant aims and objectives of the National Planning Policy Framework.
Prior to the first occupation of any individual unit forming part of the development hereby approved, an area shall be laid out within the curtilage of each business premises for the parking of cars in accordance with the Council's car parking standards and this area shall be properly consolidated, surfaced and drained in accordance with Proposed Site Plan, 6685 - 023 Rev E dated 20th January 2020 (submitted with 21/01899/RM) unless otherwise agreed in writing through the reserved matters application or a discharge of condition application . This area shall not thereafter be used for any other purpose than the parking of vehicles. Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Unless within three months of the date of this decision, a travel plan that promotes sustainable forms of access to the site with the Local Planning Authority is submitted in writing to the Local Planning Authority for approval, and unless the approved scheme is implemented within three months of the date of the Local Planning Authority's written approval, the occupation of the units 1 and 2 shall cease until such time as that scheme is approved and implemented. Units 3 and 4 hereby permitted shall not be brought into use until the applicant has submitted to and have approved in writing a travel plan that promotes sustainable forms of access to the site with the Local Planning Authority. The approved travel plans thereafter will be implemented and updated in agreement with Worcestershire County Councils Travel plan co-coordinator. Alternatively, the applicant can reach an agreement with the Highway Authority to provide travel planning services for the development. If the applicant wishes the Highway Authority to provide such services an appropriate agreement should be in place prior to the occupation of any part of the development. Reason: To ensure that the proposed development is carried out as approved in order to reduce vehicle movements and promote sustainable access, in accordance with Policy SWDP4 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out strictly in accordance with the approved bat mitigation strategy set out within the letter report by Harris Lamb Ref: PE0116/HS dated 1st July 2021. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations and the relevant aims and objectives of the National Planning Policy Framework.
The development shall be carried out strictly in accordance with the approved ecological mitigation and enhancement strategy set out within the Ecological Mitigation Enhancement Strategy (Dr Holly Smith, HLPC Letter reference PE0116/HS dated 1st July 2021). Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and the relevant aims and objectives of the National Planning Policy Framework.
Separate planning consent may be required to regularise the depositing of soil on land outside the application site.
