Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework. |
| No building operations hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the proposed dwellings and associated car ports and garage hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include the:
-type, colour and finish of all materials
-external joinery details along with architectural details of the proposed external finishes, heads, sills and any surrounding dressings (elevational drawings at a minimum scale of 1:20 and vertical sectional drawings at minimum scale of 1:2)
-details of external doors/garage doors including information on finish
The development shall be carried out using the materials as approved.
Reason: To ensure a satisfactory external appearance of the development and that high quality materials and finishes are used, in accordance with policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of National Planning Policy Framework. |
| Before the first use/occupation of the development hereby permitted, details of the boundary treatments shall be submitted to and approved in writing by the Local Planning Authority. This will include the position, design, materials and type of boundary treatments to be submitted to and approved in writing by the local planning authority. All boundary fencing shall include mammal gates/gaps to ensure permeability for small mammals. The agreed details shall be implemented thereafter.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with SWDP 21, SWDP 22 and SWDP 25 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework.

| The Development hereby approved shall not be first occupied until the access, parking and turning facilities have been provided as shown on Drawing Number 14E.
REASON: To ensure conformity with summited details and accord with Policy SWDP4 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The Development hereby approved shall not be first occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
REASON: In the interests of highway safety and in accordance with SWDP4 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation.
No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements 1 to 4 below have been complied with:
1. Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place.
2. Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
3. The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
4. Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site.
Reason- To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors and in accordance with SWDP21 and SWDP31 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| All hard and soft landscaping works, including planting, seeding/turfing, surfacing and other hard landscape features, comprised in the approved landscape scheme (reference: 14E), shall be carried out in accordance with the approved details. All hard landscaping works shall be completed prior to the first occupation/use of the development.
All planting, seeding and turfing shall be carried out in the first planting season following the first occupation/use of the development.
All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment.
Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| No development shall take place until an Ecological Mitigation Compensation and Enhancement Scheme (EMCES) has been drawn up by a suitably qualified ecologist and has been submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations made in the Preliminary Ecological Appraisal report by Brown Fisher Environmental, dated April 2025, and shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with paragraphs 187 and 193 of the National Planning Policy Framework (NPPF) and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and to accord with Policy SWDP22 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of development hereby permitted, a Lighting Design Strategy for Biodiversity shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall be based on Guidance Note 08/23. Bats and Artificial Lighting at Night, by the Bat Conservation Trust and ILP, and shall:
- Identify those areas/features on site that are particularly sensitive for nocturnal wildlife and that are likely to cause disturbance in or around their breeding sites and resting places or along important routes used to access key areas of their territory, for example, for foraging; and
- Show how and where external lighting will be installed, and impacts of internal light spill, (through the provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent nocturnal animals from using their territory or having access to their breeding sites and resting places. This will include the provision of dark corridor conditions for retained trees, hedgerows and other commuting routes.
All lighting shall be installed in accordance with the specifications and locations set out in the strategy and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority.
Reason – To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with SWDP 22 of the South Worcestershire Development Plan,2016 and accord with the aims and objectives of the National Planning Policy Framework.

| The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the Plan and maintained thereafter in accordance with the approved Landscape and Ecological Management Plan (LEMP).
Reason – To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990 and SWDP 22 of the South Worcestershire Development Plan,2016 and to accord with the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of the development hereby approved, a Landscape and Ecological Management Plan (LEMP) shall be submitted to and approved in writing by the Local Planning Authority and shall be maintained after implementation. The content of the LEMP shall include the following:
- Description and evaluation of the features to be managed;
- Ecological trends and constraints on site that might influence management;
- Aims and objectives of management;
- Appropriate management options for achieving aims and objectives;
- Prescriptions for management actions;
- Preparation of a work schedule, including an annual work plan capable of being rolled forward over a five-year period and for a minimum of 30 years thereafter;
- Details of the body or organisation responsible for implementation of the plan;
- On-going monitoring and remedial measures.
The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the LEMP are not being met, how contingencies and/or remedial action identified, agreed and to be implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.
The LEMP will be implemented in accordance with the approved details.
Reason – To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and to ensure that the proposal harmonises with the surroundings in accordance with SWDP 21, SWDP 22 and SWDP 25 of the South Worcestershire Development Plan,2016 and accords with the relevant aims and objectives of the National Planning Policy Framework.

| Prior to the commencement of the development hereby approved, the existing trees, shrubs and hedges on the site shall be protected by fencing constructed in accordance with BS 5837:2012 (trees in relation to design, demolition and construction - recommendations) and shall accord with Chapter 4 of the pre-development Tree Survey Report (ref: 247325ARB), dated 28th March 2025. These protection measures will be retained throughout the development of the site in the approved positions.
Reason: To protect the existing trees/shrubs/hedges on the site during construction work and to preserve the amenities of the locality in accordance with policies SWDP21 and SWDP22 of the South Worcestershire Development Plan, 2016 and the relevant aims and objectives of the National Planning Policy Framework.

| No dwelling hereby permitted shall be occupied until details of the design, implementation, maintenance and management of foul water drainage works have been submitted to and approved in writing by the local planning authority and thereafter implemented for use. The development shall be carried out, and the drainage maintained/managed, in accordance with the approved details thereafter for the lifetime of the development.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment in accordance with policy SWDP30 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Drainage Strategy (2302-B), undertaken by reports 4 Planning, dated the 12th January 2026 shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the occupation of development hereby permitted, the details outlined in the Energy statement shall be implemented.
Reason- To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan,2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan (2016) and the relevant aims and objectives of the National Planning Policy Framework. |
| The effect of paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the biodiversity gain condition”) that development may not begin unless:
- A Biodiversity Gain Plan has been submitted to the local planning authority; and
- The planning authority has approved the plan.
Subject to paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the Biodiversity Gain Plan must include:
- Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the on-site habitat and any other habitat;
- The pre-development biodiversity value of the on-site habitat;
- The post-development biodiversity value of the on-site habitat;

| The applicant must be aware of their obligations as follows:
No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent (this includes laying concrete, tarmac or similar).
No diminution in the width of the right of way available for use by the public.
Buildings materials must not be stored on the right of way,
Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way.
No additional barriers are placed across the right of way.
The safety of the public using the right of way is to be ensured at all times. The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown. |
