Condition Details / Information Notes
Date of Local Planning Authority’s determination that prior approval to the siting and appearance of development is required 11 June 2025. Wychavon District Council hereby give approval for the siting and appearance of the development proposed in the above-mentioned application, received on 17 April 2025 and in accordance with the attached plans, for the following reason: It is considered that the proposed mast and associated ancillary works would comply with the provisions of Class A of Schedule 2 of Part 16 of the Town and Country Planning (GDPO) (England) (Amendment) Order 2022. It is considered that the proposal would constitute permitted development and the necessary prior notification procedure has been followed by the developer. Subject to the conditions of the order, prior approval is required to the siting and appearance which has been provided by the developer and is hereby given by the Local Planning Authority. Class A development is permitted subject to the condition that— (a) any electronic communications apparatus provided in accordance with that permission is removed from the land or building on which it is situated— (i) if such development was carried out in an emergency, at the expiry of the relevant period; or (ii) in any other case, as soon as reasonably practicable after it is no longer required for electronic communications purposes; and (b) such land or building is restored to its condition before the development took place, or to any other condition as may be agreed in writing between the local planning authority and the developer.
The applicants attention is drawn to the comments of third parties on the prior notification, relating to various issues including site access, underground drainage that may be affected by the mast and its siting and the operation of the adjacent Badsey archery club, the field of which the mast would be located in. The comments can be viewed on the Council's web site and are also summarised in the delegated officer report on the notification and should be taken into account in the implementation of the prior approval hereby granted.
