Condition Details / Information Notes
The proposed change of use from Commercial, Business and Services to 1 dwelling house is not considered to constitute permitted development under Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as the existing building is considered to be unlawful. By virtue of Article 5 of the GPDO, permitted development rights do not apply where the existing building is unlawful. In this case, the building operations involved in its construction are considered unlawful, and therefore the proposal does not benefit from Class MA permitted development rights.
The proposal fails to meet the requirements of Paragraph MA.2(2)(c) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), as it has not been demonstrated that flood risk has been appropriately addressed. The Flood Risk Assessment (FRA) provides inaccurate information, specifically in regards to the site access falling within Flood Zone 2, provides insufficient information in respect of a site-specific hazard assessment and a detailed evacuation plan. As such, the applicant has failed to demonstrate that a safe access and egress can be maintained during flood events, and the development would pose an unacceptable risk to future occupiers.
