Condition Details / Information Notes
The replacement of the existing dwelling, would by virtue of the increased bulk, height, massing, and overall design of the proposed dwelling exceed the size of the original footprint by significantly more than the 30% allowance and would be disproportionately larger than the existing dwelling. Furthermore, the proposal has not demonstrated why the existing dwelling cannot be altered, extended or refurbished to meet the accommodation needs of the applicant. As such the proposal would be contrary to Policy SWDP18 of the Development Plan and represents an inappropriate form of development in the open countryside contrary to Policy SWDP2 of the South Worcestershire Development Plan (February 2016) and the provisions of the National Planning Policy Framework.
The replacement dwelling, by virtue of its bulk, height, massing and overall design and appearance, including a mix of roof and fenestration styles, with a high level of contemporary domestic style glazing, would fail to respond to and integrate with the prevailing rural character. Due to the disjointed appearance this would create an incongruous and discordant feature harmful to the rural landscape in direct conflict with the aims of Policy SWDP2 A (iii) in safeguarding and (wherever possible) enhancing the open countryside and as such contrary to policies SWDP21 and SWDP25 of the development plan (February 2016) and the provisions of the National Planning Policy Framework particularly Sections 12 which states that new development should be of high quality design and contribute positively to making places better.
The proposed development will result in the loss of a building which is currently an active bat roost and as such it is necessary to assess the proposal against the Conservation of Habitats and Species Regulations 2010 (as amended) and the derogation tests. The proposed development, however, fails to satisfy tests 1 and 2 in that the applicant has failed to demonstrate that there is an imperative reason of overriding public interest for the development and that there is no satisfactory alternative form of development such as retaining, extending and refurbishing the existing dwelling. As such the proposal would be contrary to Policy SWDP22 of the South Worcestershire Development Plan (February 2016) and the provisions of the National Planning Policy Framework.

In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
