Condition Details / Information Notes
Due to the location and amount of development through the proposed number of dwellings, the consequences of such is the proposal would introduce a new and incongruous pattern of development out of context within this area of Cutnall Green. The proposal would relate poorly to the existing settlement pattern and would fail to integrate within this part of Cutnall Green. In addition, due to the consequences of any future layout of the proposed dwellings, the proposal would fail to maintain the spacious character of the area, resulting in overdevelopment of the site. Accordingly the proposal would not represent high quality design that would integrate effectively with its surroundings contrary to Policy SWDP21 of the South Worcestershire Development Plan (February 2016), the principles of the Design Guide SPD and the provisions of the National Planning Policy Framework particularly Section 12 which states that new development should be of high quality design and contribute positively to making places better and in terms of making efficient use of land paragraph 129 part (d) which specifies desirability of maintaining an area’s prevailing character and setting (including residential gardens).
Due to the amount of development proposed within the constraints of the plot size, the result would be a cramped and visually intrusive form of development that would be harmful to the residential amenity of occupiers of the properties directly surrounding the site to their detriment. In addition, due to the substantial loss of private outdoor amenity space, this would impact on future occupiers of the host dwelling ‘Iona’ exacerbating loss of outlook and loss of privacy. As such the land use would not be appropriate for additional residential development and would be contrary to Policies SWDP21 of the Development Plan, the principles of the Design Guide SPD and the provisions of the National Planning Policy Framework in particular paragraph 135 which states that planning decisions should have a high standard of amenity for existing and future users. Accordingly, It is concluded that the amount and land use of the site is not suitable for residential development and that the proposal, considered holistically, fails to represent sustainable development.

In dealing with the application the Council has implemented the requirement in paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. The Council has however been unable to seek solutions to problems arising from this application as the applicant has failed to provide a scheme that would comply with the statutory policies of the development plan and would not overcome the reasons for refusal. Despite the Council’s efforts, it is considered that planning permission should be refused for the reasons set out in the decision notice.
