The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission W/23/00751/FUL approved on the 13th November 2024. Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended).

In the event of ground conditions not being suitable for surface water to be discharged to a soakaway, full details of surface water drainage systems to serve the development must be submitted to and approved in writing by the Local Planning Authority before the first occupation/use of the development hereby permitted. The approved drainage works shall be implemented in accordance with the approved details and retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan, and the relevant aims and objectives of National Planning Policy Framework.
The development herby permitted shall be in strict accordance with the approved external materials, finished and details contained within or shown on document titled ‘Condition no 4 Materials Sample Panels’, Drawing titled ‘24.25.004-WD700 – Details’, Drg No. 700. SERIES.2, Drawing titled ‘24.25.004-WD701 – Details’, Drg No. 700. SERIES.3, Drawing titled ‘24.25.004-WD702 – Details’, Drg No. 700. SERIES.4, Drawing titled ‘24.25.004-WD703 – Details’, Drg No. 700. SERIES.5, Drawing titled ‘24.25.004-WD704 – Details’, Drg No. 700. SERIES.6 and Drawing titled ‘24.25.004-WD705 – Details’, Drg No. 700. SERIES.7 or in accordance with the approved plans listed under Condition 2 of this Decision Notice. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to their installation as part of the development hereby approved, details of the following shall be submitted to and approved in writing by the local planning authority: - elevations and cross section details of all external windows and doors. It should be noted that, notwithstanding any submitted details, these should be of timber or metal construction. UPVC it not considered appropriate. The development shall be carried out using the materials as approved. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The development shall be in strict accordance with the approved Arboricultural Method Statement (Incorporating Tree Protection Measures) by The Environmental Dimension Partnership Ltd, dated March 2023, Report Reference edp7310_r007a. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved on drawing 02, shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or  are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions and 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. (B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 194 and 205 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
The development herby permitted shall be carried out in strict accordance with the approved Construction and Environmental Management Plan by All Ecology (Version: 1.0), dated 17th January 2025 throughout the construction period. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and SWDP policy 22 and the relevant aims and objectives of National Planning Policy Framework.
The development hereby permitted shall not be commenced until an appropriate bat license has been granted by Natural England under the Conservation of Habitats and Species Regulations 2017 and a copy of the license and detailed bat mitigation strategy has been submitted to the Local Planning Authority. Should updated surveys indicate that a license is no longer required, an appropriate bat mitigation strategy, including a detailed method statement taking into account the survey information contained within the Ecological Appraisal by EDP, ref. edp7310_r006 dated March 2023, shall be submitted to and approved in writing by the Local Planning Authority prior to any works commencing. The works shall thereafter be carried out in strict accordance with the submitted and agreed mitigation strategy. Reason - to ensure compliance with the Conservation of Habitats and Species Regulations 2017 and policy SWDP22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
The development herby permitted shall be carried out and thereafter managed in full accordance with the approved Landscape and Ecological Management Plan by All Ecology (Version: 1.0), dated 17th January 2025. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
The development herby permitted shall be in strict accordance with the approved document 'Conderton External Lighting Scheme' by Collingwood Lighting, Ref: DF8588. All external lighting shall be installed in accordance with the specifications and locations set out in the strategy, and these shall be maintained thereafter in accordance with the strategy. Under no circumstances should any other external lighting be installed without prior consent from the Local Planning Authority. Reason: To ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and minimise impacts on protected species in accordance with Policy SWDP22 and the relevant aims and objectives of National Planning Policy Framework.
Prior to their installation on site, details of any boundary treatments and fencing shall be submitted to and approved by the Local Planning Authority. The boundary treatments shall include mammal gates and/or gaps to ensure permeability for small animals. The development shall be carried out in accordance with the approved details. Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site, and to ensure the proposal harmonises with the surroundings in accordance with policies SWDP21, SWDP22 and SWDP25 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
Before the first occupation of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The details submitted shall demonstrate that the measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:- - the overall predicted energy requirements of the approved development; - the predicted energy generation from the proposed renewable/low carbon energy measures; and - an implementation timetable for the proposed measures. The development shall be carried out in accordance with the approved details.’ Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to the first occupation of any of the dwellings hereby approved, superfast broadband facilities or alternative solutions to serve the dwellings hereby approved shall be installed and shall be retained thereafter. Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
The Development hereby approved shall not be brought into use until the parking facilities have been provided as shown on Drawing No. 24.25.004-SP-WD100.E Rev B. REASON: In the interests of highway safety and to ensure the free flow of traffic in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
The Development hereby approved shall not be occupied until the visibility splays shown on Drawing 220451-RAP-XX -XX-DR-TR-3000/P01 have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. (For the avoidance of doubt, the plan referenced within this condition relates to the visibility details only and no other aspect of the approved development). REASON: In the interests of highway safety, in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 07:30 and 17:00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Prior to the first occupation of any dwelling hereby approved secure parking for cycles to comply with the Council’s standards shall be provided within the curtilage of each dwelling and these facilities shall thereafter be retained for the parking of cycles only. Reason - To comply with the Council’s parking standards in accordance with policy SWDP 4 of the South Worcestershire Development Plan and the relevant aims and objectives of National Planning Policy Framework.
Within 6 months from the date when any of the dwelling houses hereby permitted are first occupied, the land shown on the approved plan as 'Green Infrastructure' shall be laid out in accordance with the details shown on approved Drawing No. 24.25.004-SP-WD103 (Green Infrastructure Plan). Reason - To ensure the provision of adequate green space in accordance with policies SWDP5 and SWDP38 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of National Planning Policy Framework.
Notwithstanding any variations arising from amendments to approved plans listed under condition 2 of this Decision Notice, the development shall carried out in accordance with the conclusions and provisions set out in the following documents: - Landscape and Visual Appraisal ref: edp7310_r005b; - Design and Access Statement, Energy Statement and Landscape Statement dated January 2023; - Planning Statement by McLoughlin Planning Ltd dated April 2023; - Heritage Impact Assessment ref: edp7310_r009; - Heritage Baseline Assessment ref: edp7310_r004a; - Archaeology Assessment ref: edp7310_r003a; - Arboricultural Method Statement ref: edp7310_r007a; - Arboricultural Baseline Note ref: edp7310_r002b; - Ecological Appraisal ref: edp7310_r006 - Biodiversity Impact Assessment ref: edp7310_r008(1.0); - Drainage Strategy Technical Note by rappor dated March 2023; - Transport Statement by rappor dated April 2023. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Prior to installation, detailed drawings and specifications of the photovoltaic (PV) panels to be installed on the buildings shall be submitted to and approved in writing by the Local Planning Authority. The details shall include the type, size, location, orientation, appearance and the extent to which the PV panels will project or extend beyond the plane of the building’s roof. The development shall be carried out strictly in accordance with the approved details. Reason: To ensure a satisfactory form of development and that the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWPD6, SWDP21, SWDP24 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework.
Within six months of any of the solar panels/photovoltaic panels hereby permitted or as approved under Condition 22 of this Decision Notice becoming redundant, inoperative or permanently unused, those panels and all associated infrastructure shall be removed and re-used, recycled, the materials recovered, or be finally and safely disposed of to an appropriate licensed waste facility, in that order of preference. Reason: To ensure a satisfactory form of development, avoid any eyesore from redundant plant despoiling the countryside/ streetscene and its character and appearance, prevent pollution, and safeguard the environment when the materials reach their end of life, in accordance with Policies SWDP1, SWDP21, SWDP24 and SWDP31 and the relevant aims and objectives of the National Planning Policy Framework.
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein.
