Condition Details / Information Notes
The application fails to include evidence that the live-work accommodation would result in a genuine live-work proposition, due to the unit being designed in such a way that fails to offer a practical 'work' space that would be separate from the 'live' use accommodation. In particular, due to the design and appearance of the ‘work’ use part, being integrated to match the residential use, with overly domestic features, with the inclusion of a substantial amount of glazing serving the ‘workshop’, ‘meeting room’ and ‘office’ room, incorporating such domestic features as ‘bi-fold’ doors, ‘louvre shading to large glazed area’ and ‘roof overhang shading’ which is also clearly annotated on the proposed floor plan to provide a ‘veranda/shade’ to serve the ‘work’ element, the proposal fails to comply with Policy SWDP8 G parts i) and iii). As such, the proposed unit has not been designed as genuine live-work unit and due to being overly domestic in design, layout and appearance, the unit has not been designed in a way to clearly separate the ‘work’ use element from the live’ use element and as such would be integrated and designed to allow the occupation of the unit as residential use only, failing to comply with the principle of Policy SWDP 8 part G and the interpretation of a live/work unit that should be genuinely intended for employment purposes.

In dealing with the application the Council has implemented the requirement in paragraph 38 of the National Planning Policy Framework to work with the applicant in a positive and proactive way. We have made available detailed advice in the form of our statutory policies in the Development Plan, Supplementary Planning Documents, as well as offering a full pre-application advice service in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. Due to the failure of the applicant to provide sufficient information and adequate level of detail to provide a scheme that would overcome the reasons for refusal, despite the Council’s efforts, it is considered that consent can be refused for the reasons as set out in the decision notice.
