| The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
| Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents:
• Location Plan CDS-C1189-P01-L-001-000 dated 17.09.2024;
• General Site Layout CDS-C1189-P01-L-004 Rev 7 dated 05.06.2025;
• Planting Plan CDS-C1189-P01-L -005 dated May 2025;
• Habitat Enhancement Plan CDS-C1189-P01-L-007 Rev 2 dated 05.06.2025;
• A Tier 2 Groundwater Risk Assessment Report for Westall Park CDS-Westall-24_rev2 dated 31st July 2025.
Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the recommendations contained within the Ecological Impact Assessment (EcIA) by Ecology by Design Ltd, dated May 2025.
Reason: In the interests of protecting the habitats of the species identified on site, having regard to the duties outlined in the Wildlife and Countryside Act 1981 (as amended), Natural Environment and Rural Communities Act 2006, the Conservation of Habitats and Species Regulations 2017 (Habitats Regulations 2017), policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| (A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and:
1) The programme and methodology of site investigation and recording.
2) The programme for post investigation assessment.
3) Provision to be made for analysis of the site investigation and recording.
4) Provision to be made for publication and dissemination of the analysis and records of the site investigation.
5) Provision to be made for archive deposition of the analysis and records of the site investigation.
6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation.
(B) The development shall not be commenced until the site investigation has been completed in accordance with Part A. The development shall not be occupied until the post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured.
Reason: The agreement of archaeological works prior to the commencement of development is fundamental to ensure that an appropriate investigation of potential archaeological deposits is secured, in accordance with the requirements of policies SWDP6 & SWDP24 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| No development shall take place (including any ground work or site clearance) until a Construction Environmental Management Plan for Biodiversity (CEMP: Biodiversity), to be informed by updated surveys, where appropriate, has been submitted to and approved in writing by the Local Planning Authority. The CEMP: Biodiversity shall include the following:
• Risk assessment of potentially damaging construction activities;
• Identification of Biodiversity Protection Zones;
• Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction (may be provided as a set of method statements);
• The location and timing of sensitive works to avoid harm to biodiversity features;
• The times during construction when specialist ecologists need to be present on site to oversee works;
• Responsible persons and lines of communications;
• The role and responsibilities of an Ecological Clerk of Works (ECoW) or similarly competent person;
• Use of protective fences, exclusion barriers and warning signs.
The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority.
Reason: To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area to ensure compliance with policy SWDP25 of the South Worcestershire Development Plan, the relevant aims and objectives of the National Planning Policy Framework, the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017. |
| The development shall not commence until a Habitat Management and Monitoring Plan (HMMP) has been prepared in accordance with the approved Biodiversity Gain Plan and the approved landscape scheme and has been submitted to and approved in writing by the Local Planning Authority. It shall be based on the recommendations made in the Ecology Technical Note (Ecological Appraisal Addendum) from EDP, dated July 2025, and shall include:
(a) A non-technical summary;
(b) The roles and responsibilities of the people and organisation(s) delivering the HMMP;
(c) The planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved biodiversity gain plan;
(d) The management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and
(e) The monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority. Notice in writing shall be given to the Council when the habitat creation and enhancement works, as set out in the HMMP, have been completed.
The created and enhanced habitat specified in the approved HMMP shall thereafter be managed and maintained in accordance with the approved HMMP. Monitoring reports shall be submitted to the local planning authority in writing in accordance with the methodology and frequency specified in the approved HMMP. The plan shall also set out where the results of the monitoring show that conservation aims and objectives of the HMMP are not being met, how contingencies and/or remedial action are identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme.
Reason: To ensure that the development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990, policy SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Temporary fencing for the protection of all retained trees/hedges shall be erected in accordance with The Tree Constraints and Protection Plans (Existing and Proposed) Appendix 3 contained within the Tree Survey Report by RGS Arboricultural Consultants, before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts.
This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use of the development hereby permitted, the details set out in the submitted Flood Risk Assessment and Sustainable Surface Water Drainage Strategy by Broughton Beatty Wearring Limited, dated May 2025, shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported immediately to the Local Planning Authority. The applicant is advised to immediately seek the advice of an independent geo-environmental consultant experienced in contaminated land risk assessment, including intrusive investigations and remediation.
No further works should be undertaken in the areas of suspected contamination, other than that work required to be carried out as part of an approved remediation scheme, unless otherwise agreed by the Local Planning Authority, until requirements (a) to (d) below have been complied with:
(a) Detailed site investigation and risk assessment must be undertaken by competent persons in accordance with the Environment Agency's 'Land Contamination: Risk Management' guidance and a written report of the findings produced. The risk assessment must be designed to assess the nature and extent of suspected contamination and approved by the Local Planning Authority prior to any further development taking place.
(b) Where identified as necessary, a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to identified receptors must be prepared and is subject to the approval of the Local Planning Authority in advance of undertaking. The remediation scheme must ensure that the site will not qualify as Contaminated Land under Part 2A Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
(c) The approved remediation scheme must be carried out in accordance with its terms prior to the re-commencement of any site works in the areas of suspected contamination, other than that work required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority.
(d) Following completion of measures identified in the approved remediation scheme a verification report that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval of the Local Planning Authority prior to the occupation of any buildings on site.
Reason: To ensure that the risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property, and ecosystems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policy SWDP31 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Prior to the first use of the development hereby approved, 2no. bat boxes and 2no. bird nesting boxes (e.g a house sparrow terrace) shall be installed per recommendations R5: Bat Boxes and R10: Bird Boxes contained within the Ecological Impact Assessment, dated May 2025. The habitat boxes shall remain thereafter.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The Development hereby approved shall not be brought into use until the access, parking and turning facilities have been provided as shown on Drawing CDS-C1189-P01-L-004.
Reason: In the interests of and for the safety of persons and vehicles using the premises and/or the adjoining road, having regard to policy SWDP21 of the South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| No external means of illumination shall be installed or operated at the site, except that which is in accordance with details that are first submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details and retained thereafter.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| Before the commencement of construction works on the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan and the relevant aims and objectives of the National Planning Policy Framework. |
| The approved Biodiversity Gain Plan required by paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 shall be implemented in accordance with the details and timescale agreed within the plan and maintained thereafter in accordance with the approved Habitat Management and Monitoring Plan (HMMP).
Reason: To ensure that the proposed development delivers a biodiversity net gain in accordance with Schedule 7A of the Town and Country Planning Act 1990, policy SWDP 22 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Burials shall not take place within a minimum distance of: 250 metres of any potable supply (including wells and boreholes); 30m from any surface watercourse, spring or pond; and 10m of any field drain. Burials shall take place within the unsaturated zone (between the land surface and the water table).
Reason: To protect ground and surface waters (‘controlled waters’ as defined under the Water Resources Act 1991) from pollution having regard to policy SWDP31 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| The memorials and grave markers to be sited at the premises in connection with the development shall not exceed a height of 90mm above ground level.
Reason: To safeguard the landscape quality of the area having regard to policy SWDP25 of the South Worcestershire Development Plan 2016 and the relevant aims and objectives of the National Planning Policy Framework. |
| Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information following receipt of the application and by considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
| The effect of paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (the biodiversity gain condition) that development may not begin unless:
a) a Biodiversity Gain Plan has been submitted to the Local Planning Authority;
b) and The planning authority has approved the plan.
Subject to paragraph 14(2) of Schedule 7A of the Town and Country Planning Act 1990, the biodiversity gain plan must include:
(i) Information about the steps taken or to be taken to minimise the adverse effect of the development on the biodiversity of the on-site habitat and any other habitat;
(ii) The pre-development biodiversity value of the on-site habitat;
(iii) The post-development biodiversity value of the on-site habitat.

| Operators of cemeteries should take appropriate measures to manage their sites to ensure they do not cause an unacceptable risk to groundwater quality. The Environment Agency has powers under the Environmental Permitting Regulations 2010 to take action where
groundwater pollution occurs, or is likely to occur.
If pollution was to occur, Section 161, Water Resources Act 1991 empowers us to recover all costs reasonably incurred in:
• carrying out works, operations or investigations to prevent pollution of surface waters or groundwater;
• undertaking remedial action following a pollution of surface waters or groundwater.
Should we be required to undertake such work we would be able to recover these from the company or person responsible. |
| A fee is chargeable for the provision of archaeological curatorial services. The service includes advice and liaison throughout the archaeological works, including the provision of a brief (if requested), checking the Written Scheme of Investigation for compliance with local and national standards, monitoring fieldwork and ensuring any archaeological reports generated by the project are acceptable. The Archaeology and Planning Advisor will be happy to offer advice on all stages of the proceedings. Additional site visits will be chargeable at £60 per visit if required if it is considered that breaches of condition have taken place or when other situations arise that require a visit additional to the usual service. |
| It should be noted that the proposed outfall headwall, within the adjacent watercourse, will require Ordinary Watercourse Land Drainage Consent. This consent must be approved prior to any works commencing on site. The consent is obtained from the Engineering Section.

| All cemetery developments and burials must maintain an unsaturated zone below the level of the base of the grave(s). There should be at least one metre of unsaturated zone (the depth to the water table) below the base of any grave. Allowance should also be made to any potential rise in the water table (at least one metre should be maintained). |
