Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference W/25/01191/CLPU registered on 9 July 2025 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice as the matter described in the First Schedule to this Notice would not be lawful as at the 9 July 2025 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- That the matter described in the First Schedule constitutes development within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended). The proposals to alter the existing outbuilding would not comply with the criteria outlined at Class E, Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (GPDO). In particular the proposals do not comply with criterion E(ii). Furthermore, the description of the development is ambiguous and it can therefore not be established whether the proposal would result in a material change of use of the land and the creation of an independent planning unit. The proposal would therefore require planning permission.
